10. WITH RESPECT TO KERR COAL'S PLAN FOR MITIGATION OF POSSIBLE IMPACTS ON <br />SAGE GROUSE, PRECISE LOCATIOtJS FOR FERTILIZER APPLICATION MUST BE <br />SUBMITTED EACH YEAR TO THE MINED LAND RECLAMATION DIVISION FOR APPROVAL, <br />AT LEAST 30 DAYS PRIOR TO THE SCHEDULED FERTILIZATION DATE. SUCH <br />APPROVAL SHALL BE BASED ON A COMPARISON (TO BE PROVIDED BY KERR COAL) AT <br />AREAS TO BE FERTILIZED WITH AREAS TO BE DISTURBED, RELATIVE TO SAGE <br />GROUSE HABITAT TYPES AS SHOWN ON MAP 23. A DISCUSSION OF THESE AREAS <br />WITH RESPECT TO SAGE GROUSE USE AND ACCESSIBILITY TO THE BIRDS MUST ALSO <br />BE PROVIDED. <br />Stipulation 10 was withdrawn following Kerr's submittal of Technical <br />Revision 1 on 10/12/83 to eliminate the sage grouse fertilization <br />program. This was approved on 12/6/83, and resulted in the elimination <br />of pages 780-52aaaa - 780-54aaaa. <br />11. KERR COAL IS DIRECTED TO SUBMIT TO THIS DIVISION ON A REGULAR BASIS DATA <br />FROM THE AERIAL VOLUMETRIC SURVEYING PROGRAM DESCRIBED ON PAGE 816-124 OF <br />THE APPLICATION, TO DETERMINE WHETHER FUTURE OPERATIONAL EXPERIENCE IS <br />CONSISTENT WITH THE PRQIECTED SWELL FACTOR OF 24 b. <br />Stipulation 11 was replaced by Stipulation 2 in the Permit Renewal <br />Findings document of 4/24/86. The stipulation is on-going. Kerr <br />submitted the results of such a program in April, 1987. <br />12. NO LATER THAN 90 DAYS PRIOR TO THE SCHEDULED COMMENCEMENT OF OPERATIONS <br />ON THE SECOND BONDING INCREMENT (AS SHOWN ON MAP 4b) KERR COAL MUST <br />SUBMIT DETAILED WORST CASE RECLAMATION COST ESTIMATES TO THE DIVISION FOR <br />REVIEW. ANY REQUIRED ADDITIONAL BOND AMOUNT MUST BE SUBMITTED AND <br />APPROVED PRIOR TO THE COMMENCEMENT OF OPERATIONS ON THAT INCREMENT. A <br />SIMILAR PROCEDURE SHALL BE FOLLOWED FOR ANY SUBSEQUENT INCREMENTS. <br />Stipulation 12 was replaced by Stipulation 3 in the Permit Renewal <br />Findings document of 4/24/86. Map 4b is incorrectly referenced in <br />Stipulation 12; it should be tdap 46. The stipulation is on-going. <br />-3- <br />
