<br />On March 26, 1992, NOV C-92-005 was issued for using a non-haul road as a haul <br />road. Abatement was immediate and the NOV was terminated on June 30, 1992. A <br />proposed civil penalty of $1500.00, issued on September 14, 1992, was reduced <br />to $1000.00 in an assessment conference held on October 28, 1992. Failure to <br />sign the assessment conference agreement within the specified time resulted in <br />a Notice and Order to Pay the fixed penalty of $1500.00, being issued on <br />November 27, 1992. <br />Section II - Revisions to the Permit <br />Since permit renewal on January 24, 1989, Wyoming Fuel Company has submitted, <br />and decisions were made on the following permit revisions for the New Elk Mine: <br />Minor Revision No. 18 was submitted on January 27, 1989 and was approved on <br />February 8, 1989. It requested a small area exemption for the refuse disposal <br />area beltway. <br />Minor Revision No. 19 was submitted on February 8, 1989 and was approved on <br />February 14, 1989. It involved an addition to the preparation plant <br />building. Bond was increased by $6213.00. <br />Minor Revision No. 20 was submitted <br />February 24, 1989. It involved the <br />increased by $422.00. <br />on February 14, 1989 and was approved <br />installation of an ash analyzer. Bond was <br />Minor Revision No. 21 was submitted on August 8, 1991 and was approved on <br />August 8, 1989. Two culverts were removed and one ditch was relocated. <br />Stipulation No. 43 required an updating of Map No. 13. <br />Minor Revision No. 22 was submitted on August 17, 1989 and was approved on <br />August 21, 1989. The topsoil pile was relocated. <br />Minor Revision No. 23 was submitted on September 25, 1989 and was approved on <br />September 27, 1989. The raw and clean coal storage areas were expanded. <br />Technical Revision No. 15 was submitted on August 21, 1989 and was withdrawn <br />on October 16, 1989. <br />Minor Revision No. 24 was submitted on October 26, 1989 and was approved <br />October 26, 1989. All of the mine's sediment ponds and treatment ponds were <br />cleaned and the excavated material was placed on the development waste pile. <br />Stipulation No. 44 required permit updating. <br />Minor Revision No. 25 was submitted on November 7, 1989 and was approved on <br />November 17, 1989. It involved the construction of a diesel fuel station. <br />Bond was increased by $1731.00. <br />Minor Revision No. 26 was submitted on November 16, 1989 and was approved on <br />November 20, 1989. A clean coal sampling system was constructed. Bond was <br />increased by $988.90. <br />-4- <br />
