January 2004 <br />Interior finds that there are no significant recreational, timber, economic, or other values which may be <br />incompatible with such surface mining operations The DN for this EA will include a statement of finding <br />concerning compatibility of the selected action with other resource values in the project area <br />The proposed projects lie within the approved CDMG permit area for the West Elk Mine The CDMG <br />enforces specific performance standards and permit requirements under the state program during the <br />period of mine operation, reclamation, and an extended reclamation liability period and has primary <br />authority in environmental emergencies The CDMG-operates under an Office of Surface Mining (OSM) <br />approved permanent program for administering coal mining operations in the State of Colorado The <br />performance standards for drilling, surface disturbance, road construction, mitigation and monitoring, and <br />reclamation administered by CDMG are part of the Colorado Surface Coal Mining Reclamation Act <br />regulations, which are based on requirements in Title 30 CFR Chapter VII, Part 816 <br />The CDMG is responsible for ongoing permit compliance, including inspection and enforcement <br />requirements, during the mine's operation OSM retains oversight responsibility for state compliance and <br />enforcement activities <br />Federal coal leaseholders in Colorado must submit a permit application package (PAP) to OSM and <br />CDMG for proposed mining and reclamation operations on Federal lands in the state The CDMG <br />provides opportunity for public review of and input on the PAP and reviews the package to assure that the <br />permit application complies with applicable permitting requirements and that the coal mining operation will <br />meet the approved state permanent program performance standards. If it does comply, CDMG issues the <br />applicant a permit to conduct coal mining operations. Based on the proposed projects, MCC will submit to <br />the CDMG for review and approval, a request for either a technical or minor revision to their existing <br />approved mining permit CDMG will consider any public input, this environmental analysis, the Forest <br />Service Deciding Official's Decision Notice, and other relevant criteria in their decision of whether or not to <br />approve the technical revision application <br />In 2000, the Forest Service proposed to prohibit future road construction and reconstruction of inventoried <br />roadless areas After public input and environmental analysis, the Forest Service published the final <br />Roadless Area Conservation Rule (RACR) in the Federal Register on January 12, 2001. It included <br />specific prohibitions on road construction and reconstruction in IRAs on National Forest lands. As of <br />2003, the RACR has been permanently enjoined from implementation by the Federal courts <br />The Forest Service Chief issued an Interim Directive (ID) to the Forest Service Manual on December 14, <br />2001 that guides roadless area management for a period of 18 months In this directive (ID, FSM 1900 <br />Chapter 1920), the Chief delegated decision authority to the Regional Forester to act as the Responsible <br />Official for certain decisions on road construction/reconstruction projects in an inventoried roadless area <br />(ID 1925 04b) This directive expired in June 2003. No other directive has been issued <br />On January 12, 2001, the Forest Service adopted the Road Management Strategy (66 FR 3219, Title 36 <br />CFR Part 212) consisting of revisions to the Federal Regulations governing the Forest Transportation <br />System and administrative directives for transportation atlas, records, and analysis Then, the Forest <br />Service Chief issued a second ID to the Forest Service Manual on December 14, 2001 that guides <br />transportation analysis This ID (FSM 7700, chapter 7710) directs Forest Supervisors to perform aforest- <br />wide, watershed level or project level roads analysis before deciding to construct, reconstruct, or <br />decommission roads A roads analysis was prepared for the project area in the Panels 16-24 EA, and will <br />be updated for this analysis <br />Environmental Assessment <br />Sylvester Gulch Road Construction /Box Canyon Coal Methane Drainage Wells / <br />Box Canyon Shallow Seismic Reflection Survey <br />Gunnison County, Colorado <br />I <br />^ <br /> <br />
