January 2004 <br />Coal Lease C-1362 was issued in 1967 Stipulations were added to the lease in 1997 to bring the lease <br />into accordance with the GMUG National Forest amended Land and Resource Management Plan <br />(LRMP) <br />Coal Lease COC-56447 was issued on June 1, 1995 and modified on October 15, 2001 Coal Lease <br />COC-56447 is subject to the same stipulations on Coal Lease C-1362 In addition, Lease COC-56447 <br />includes stipulations regarding threatened and endangered species, water, and the State Highway 133 <br />right-of-way. The following summarizes the applicable lease stipulations <br />• Timing Limit Stipulation, Big Game Winter Range - No surtace use allowed for exploration, <br />drilling, and development activities between December 1 and April 30 for designated winter <br />range Operation and maintenance activities are allowed New roads constructed will be closed <br />yearlong to public access <br />• Controlled Surface Use Stipulation, Big Game Winter Range -Operation and maintenance of <br />facilities associated with coal mining will be scheduled to minimize adverse effects on elk <br />between December 1 and April 30 for designated winter range Road use would be limited to <br />periods when animals are not present and restricted to authorized mine personnel <br />• Controlled Surtace Use Stipulation, Slopes 40-60 percent -Environmental analysis and <br />mitigation plans will be required on areas where slopes range from 40-60 percent <br />• No Surface Occupancy Stipulation, Slopes > 60 percent - No surface occupancy or use is <br />allowed in areas where slopes are > 60 percent <br />• Controlled Surtace Use Stipulation, Moderate Geologic Hazards -Environmental analysis and <br />mitigation plans will be required on areas having moderate geologic hazards <br />• No Surtace Occupancy Stipulation, High Geologic Hazards - No surtace occupancy or use is <br />allowed in areas having high geologic hazards. <br />• No Surface Occupancy Stipulation, Wetlands/Floodplains/Riparian Areas - No surtace <br />occupancy or use is allowed on lands defined (in the stipulation) as a wetland, floodplain, or <br />riparian area <br />The Forest Officer may consider authorizing the BLM to modify (permanently change), waive <br />(permanently remove), or grant an exception (case by case exemption) to a stipulation that was included <br />in the lease at the direction of the Forest Service Modifications, waivers, and exceptions may be <br />authorized provided <br />• The action would be consistent with federal laws and the Forest Plan <br />• The action is acceptable based on environmental review <br />• The management objectives can be met without the stipulation's restrictions because the <br />resource conditions have changed or because of the nature, location, timing, or design of the <br />proposed action <br />The Surface Mining Control and Reclamation Act of 1977 (SMCRA) establishes requirements for <br />planning, permitting, and monitoring compliance with specific operation and reclamation requirements for <br />surface disturbance associated with surtace and underground coal mining operations SMCRA states that <br />surface coal mining operations may be permitted on National Forest System lands if the Secretary of the <br />Environmental Assessment <br />Sylvester Gulch Road Construction /Box Canyon Coal Methane Drainage Wells / <br />Box Canyon Shallow Seismic Reflection Survey <br />Gunnison County, Colorado <br />
