On May 5, 2001, the Division recommended approval of Four States' application over <br />the sixteen objections, including those filed by the Plaintiffs. Vol: 2, p. 748. The Board's <br />prehearing conference officer met with the parties in Durango, Colorado on May 15~', and <br />prepared a proposed prehearing order. Vol. 2-3, pp. 834; 1018-1020. <br />The Boazd conducted the hearing in question on May 23, 2001. VoZ. 3, p. 1018. All <br />Plaintiffs appeared. Vol. 3, pp. 1044, 1055, 1093. Plaintiffs Akin and Stepe were represented by <br />counsel. Vol. 3, p. 1055. The Board considered the proposed prehearing order at the beginning <br />of the hearing and, hearing no objection from any party, adopted it. Vol. 3, pp. 1018-1021. <br />No Plaintiff retained an expert witness to testify. Marilyn Boynton testified, offering <br />opinions to support her case. Ms. Boynton has a degree in English and has studied geology. Vol. <br />3, p. 1045. One other party who is not a plaintiff has a degree in chemistry. Vol. 3, p. 1132. <br />Two of the three Plaintiffs present at the hearing testified. No Plaintiff used all of his or her <br />time, allotted in the prehearing order. VoZ. 3, p. 1280. <br />Plaintiffs Akin and Stepe subpoenaed David Holm, then the Director of the Colorado <br />Water Quality Control Division, Department of Public Health and Environment (hereinafter <br />WQCD), purportedly for the purpose of explaining the implementation of WQCD regulations, <br />Colorado's compliance with the Federal Clean Water Act and Four States' noncompliance with <br />water quality laws. Mr. Akin and Ms. Stepe subpoenaed Cris Gates of the WQCD for largely the <br />same purpose. Finally, they subpoenaed Wallace Erickson, who is the Environmental Specialist <br />who was responsible for the review of this application for the Division. Vol 3, pp. 847-848. <br />Marilyn Boynton made no requests for subpoena. <br />
