Page 25 <br />Construction Materials Rule 1 <br />(i) al] Owners of Record of surface and mineral <br />rights to the affected land; and <br />(ii) atl Owners of Record of surface lands that aze <br />within 200 feet of the boundary of the affected land. <br />t to(s)(c) (f) As soon as designated by the Office, mail a copy of the <br />tt2(9)(c) Notice provided for in Subparagraph 1.6.2(1)(d) to any other Owners <br />of Record who might be affected by the proposed mining operation. <br />The Office shall designate such owners; if any, within orie (1) week <br />after the application is filed. (Not applicable to Special 111 Operation <br />Permit applications.) <br />t to(s)(c) (g) Prior to Office consideration of the application, submit <br />t t2(9)(c) proof of publication and proof of all required notices. Proof of Notice <br />may be by subnutting return receipts of a Certified mailing or by proof <br />of peisonal service. An application will be considered filed by the <br />Office when the Applicant supplies the proper application fee and a <br />signed affidavit that all notices as provided for in Pazagraph 1.6.2(1)(b) <br />have been posted. Prior to a decision by the Office to approve of the <br />application; proof of notice provided for in Subpazagraphs 1.6.2(1)(d), <br />(e), and (f) must be received by the Office. <br />tto(5)(c)(2) The copy of the application and any amendments placed at the office <br />112(9)(a) of the County Clerk or Recorder shall not be recorded, but shall be <br />retained there foi at least sixty (60) days after a decision on said <br />application has been made by the Office and be available for inspection <br />during such period, and at the end of such period, such application may <br />be reclaimed by the Applicant or destroyed. <br />1.6.3 Specific Provisions -Limited Impact 110 <br />(1) The following Notice Rules apply to applications for new <br />Limited Impact 110 Permits. <br />(2) The Office shall give written notice, by mailing, of the decision <br />date for the application, which shall not be more than thirty (30) days after the <br />date the application is filed: <br />
