Page 17 <br />Construction Materials Rule 1 <br />(2.5) Proof of the notices required pursuant to Subparagraphs <br />1.6.2(1)(d), (e), and (f) is not required in order for a file to be complete, but <br />such proof must be submitted to the Office prior to the Office's decision to <br />approve an application, pursuant to 1.6.2(1)(g). <br />(ii) all. information, attachments, maps, and <br />exhibits, as listed and described in Subsection 1.4.1 and Section <br />6.4; <br />(iii) an affidavit that notice signs were posted on-site <br />pursuant to Subsection 1.6.2(1)(b); <br />(iv) the appropriate information under Subsection <br />6.5 if required by the Office <br />[t5(1) (3) When an application has been filed, the Office shall set a date <br />for the consideration of the application. Where written objections have been <br />received within the applicable time period, such date shall not be less than <br />thirty (30) days after the last day allowed for the filing of written objections to <br />or statements in support of the application, and no. more than one hundred <br />twenty (120) days .after filing the application with the Office, except for <br />applications submitted under the provisions of Pazagraph 1.4.1(7). The date <br />set for consideration of the application maybe extended, pursuant to Section <br />1.8, if the Applicant changes the application. Such date shall not be extended <br />beyond ninety (90) .days after the last amended filing. At the request of the <br />Applicant, the review time maybe extended and the decision date reset, not to <br />exceed 365 days from the date the application is filed for review in order to <br />allow the Applicant an opportunity to provide additional information to meet <br />adequacy requirements of the Office. If, at the end of the 365 day period, the <br />application has outstanding adequacy issues, the Office may set the matter for <br />a Board hearing. At the Hearing the Boazd may decide to deny, or approve the <br />application. The Applicant has the burden of demonstrating that the <br />application meets the minimum requirements of the Act, Rules and <br />Regulations. <br />(4) On the date set for consideration, the Office shall approve or <br />deny the application, or set the matter for a hearing before the Boazd.
