Page 16 <br />Construction Materials Rule I <br />(1) Prior to submission of an application for a Special 111 Pemilt, <br />any County Applicant shall apply for and receive a Declazatory Order by the <br />MLRB that it qualifies for a Special 111 Operation Permit. <br />1u(1) (2) .All gerieral application requirements outlined in Subsection <br />u1(2) 1.4.1, and Paragraphs 1.4.2(2) and (4) shall be required for and apply to a <br />Special 111 Operation. <br />111(5) (3) The Office shall approve or deny the application within fifreen <br />(15) calendar days after the date the application is filed. <br />(4) In the event of an objection regarding the approval, denial or <br />modification of a Special 111 Operation.Permit, the provisions of Pazagraph <br />1.4.2(4) shall apply. <br />111(6) (5) A governmental subdivision shall be exempt from an application <br />fee and a Financial Warranty when such subdivision, acting as an Operator, <br />requires a permit solely to extract construction material for the construction of <br />public roads under a contract .with the Department of Transportation or <br />otherwise. <br />1.4.5 Specific Requirements -Regular 112 Operations (see Figure 3) <br />(1) All general application requirements outlined in Subsection <br />1.4.1, shall be required for a Regular Operation. <br />(2) An application will be considered filed for the purpose of <br />calculating the decision-making time periods under Section 34-32.5-,115(1), <br />C.R.S., as amended, when the application file includes all of the following <br />submittals: <br />(a) The application fee, as determined under Section 34- <br />32.5-125 C.R.S., as amended; <br />(b) one (1) original and four (4) copies of: <br />(i) the application form; <br />
