Page 6 Construction Materials Rule 1 115 .. limited to heazings, rule-making proceedings in accordance with the Administrative Procedures Act, Section 24-4-103, C.R.S. 1984,. as amended, and executive sessions. 1o3(tz) (26) "Mining" means the extraction of construction materials. 103(13) (27) "Minine Operation" means the development or extraction of a construction material from its natural occurrences on affected land. The term includes, but is not limited to, open mining and surface operation and the disposal of refuse from underground and in situ mining. The term includes transportation or processing on affected lands. The term does not iriclude: the exploration and extraction.of natural petroleum in a liquid or gaseous state by means of wells or pipe; the development or extraction of coal; the extraction of geothermal . resources; smelting, refining, . cleaning, prepazation, transportation, and other off-site operations not conducted on affected land. (28) "Modification" means any amendment or revision of any previously granted permit, including permit transfers, increases or decreases of the amount of financial warranty required by the Board, and declazations regazding temporary cessation, which is either: (a) initiated by the Boazd pursuant to Subsection 3.3.2 as necessary to bring the operation into compliance with the provisions of these Rules or the Act, or (b) the subject.of a petition fora formal hearing granted by the Boazd pursuant.to Section 34-32.5-114 of the Act to3(ta) (29) "Office" means the Office of Mined Land Reclamation within the Division of Minerals and Geology (DMG). (30) "Off-site" means an area defined by a proposed or existing construction project, where such project azea does not include the site of construction material extraction nor is it immediately adjacent to such site of extraction. )n relation to an extraction operation, it means that area outside the permit azea.
