Page-3 <br />Construction Materials Rule 1 <br />appropriate annual fees. As a guideline, "Similarly situated sand, gravel or <br />quarry operations" means those operations within a county which, due to their <br />location, hydrology; geology, or topography, have similaz requirements for <br />mining and reclamation. As a guideline to the counties, the Boazd suggests <br />that the following situations aze disfinct from each other, and reasonable <br />classifications of "similarly situated" operations: <br />(a) dry alluvial operation: Operation in alluvial material <br />where no groundwater is encountered; <br />(b) wet alluvial operation: Operation in alluvial material <br />where <br />groundwater is encountered; <br />(c) dry non-alluvial operation: Operation in non-alluvial <br />material where no groundwater is encountered; <br />(d) wet non-alluvial operation: Operation in non-alluvial <br />material where groundwater is encountered; and <br />(e) in addition, other physical factors such as substantial <br />differences in elevation, aspect, or vegetation may distinguish <br />operations which would otherwise fall within a single one of the four <br />classifications set forth above. <br />103(4) (13) "E~loration" means the act of seazching for or investigating a <br />construction material deposit. "Exploration" includes, but is not limited to, <br />sinking shafts, tunneling, drilling core and bore holes and digging pits or cuts <br />and other works for the purpose of extracting samples prior to commencement <br />of development"or extraction operations, and the building of roads, access <br />ways, and other facilities related to such work. The term does not include <br />those activities which cause no or very little surface disturbance, such as <br />'airborne surveys and photographs, use of instruments or devices which are <br />hand carried or otherwise transported over the surface to make magnetic, <br />radioactive, or other tests and measurements, boundary or claim surveying, <br />location work, or other work which causes no greater land disturbance than is <br />caused by ordinary lawful use of the land by persons not exploring. <br />
