Page 2 . <br />Construction Materials Rule 1 <br />mining operations permitted on or after January 31, 1994, ambient groundwater <br />shall mean the quality of groundwater at the time of submittal of the pemut <br />application. In establishing ambient groundwater quality,. an Operator or <br />Applicant shall use available or collected groundwater data sufficient to <br />chazacterize .the site's ambient groundwater quality and submit such <br />information in a form suitable to the Office. <br />(6) "Amendment" means a change in the peinut or an application <br />which increases the acreage of the affected land, or which has a significant <br />effect uponthe approved or proposed Reclamation Plan. <br />(7) "Applicant" means any person who applies to the Office for a <br />mining permit. <br />(8) "Authorized Aeent" means any corporate officer, corporate <br />attorney, individual person, or persons. so designated in the permit application. <br />(9) "Certification by an Independent Auditor" means a letter or <br />report from a Certified Public Accountant rendering an opinion as to the <br />financial condition of a Financial Warrantor with regard to the financial tests <br />required for self-insurance. The opinion must demonstrate cleazly grid fully, <br />without significant disclaimers, that the financial tests have been met by the <br />Financial Warrantor. <br />115(2) (10) "Complex Application" is an application which may require the <br />Office to involve additional professional staff or outside professional or agency <br />expertise, and is beyond what the Office considers to be a typical application <br />review process for the majority of applications received. <br />103(3) (I1) "Construction Material" means rock, clay, silt, sand, gravel, <br />limestone, dimension stone, mazble or shale extracted for use in the production <br />of non-metallic construction products. <br />110(6) (12) "County Composite Applications" means the operator is a unit <br />of county government and'has the discretion to submit one (1) composite <br />application for all similazly situated sand, gravel, or quarry operations which <br />qualify as limited imgact as described in these definitions.
