Coors Energy Companu <br />}:EENSBURG MINE <br />Findings <br />I. Legal, Financial and Compliance Information (2.03y <br />The applicant (Coors Energy Company) has provided copies of the documents of <br />conveyance granting to the applicant the right to extract coal by surface <br />min%ng methods, in such instance where the private mineral estate is severed <br />from the private surface estate, as reouired under section 2.03.6(2). The <br />Division (Mined Land Reclamationl has re viewed these documents and finds the <br />applicant in compliance with section 2.03.6(2) of the reculations. (2.07.6 <br />(21 (f)) <br />On the basis of evidence submitted on page 8 of the application, the Division <br />finds that Coors Energy Company does not own or control any operations which <br />are currently in violation of any Iaw, rule, or regulation of the United States, <br />or any State law, rule, or regulation, oz any provision of the Surface Mining <br />Control and Reclamation Act or the Colorado Surface Coal Mining Reclamation <br />Act. (2.07.6(2)(8)) <br />Coors Energy Company does not control and has not controlled mining operations <br />with a demonstrated pattern of willful violations of the Act of such nature, <br />duration, and with'such resulting irreparable damage to the environment as to <br />indicate an intent not to comply with the provisions of the Act. (2.07.6(2)(h)) <br />The proposed operation is in compliance. <br />II. Land Use (2.09.3, 2.05:5, 5.16) <br />The Division hereby approves the post-mining land use of the proposed operation. <br />It was determined that rangeland met the requirements of section 9.16. <br />(2.07.6(2)(1)) <br />III. Cultural and Historic Resources (2.04.4, 2.05.6(9)) <br />The applicant submitted a report from Cultural Resource Consultants, Inc., <br />to ensure compliance with the State An tiouities Rct of 1973, the State Register <br />of Historic Places Act of 1975 and the National Historic Preservation Act of 1966. <br />The report consisted of a site-specific literature search supplemented by un- <br />site inspection by archaeologists. Based on this report, and on contacts made <br />with the State Historical Preservation Officer, the Division finds that the <br />proposed mining operation will not adversely affect any publicly owned pack <br />or place listed on the National Register of Historic Places. (2.07.6(2}(e)) <br />IV. Geology (2.09.5 and 2.09.6(2)) <br />The operation is located in the Colorado Piedmont section of the Great Plains. <br />Mining will extract the No. 7 coal seam of the Laramie Formation. Geologic <br />information contained in Appendix I-1 and page 23 and 24 of the application <br />characterize the unique geology of this mine. The flatlying coal seam is overlain <br />by 60-100 feet of overburden consisting of yellow-brown and gray to blue gray <br />soft carbonaceous shale and clay interbedded with sand and shaley sand. It <br />contains some cross bedded gray to buff sandstone which is slightly to well <br />cemented. The bedrock is overlain by 10 to 25 feet of aeolian sand which poses <br /> <br />
