- I4- <br />.. <br />The applicant has projected swell factors based on observed swell factors <br />exhibited at a comparable mine. To further define the swell factors for the <br />Keenesburg Mine, the applicant proposes to submit actual swell factors for the <br />mine as information becomes available. However, since actual operating conditions <br />may result in swell factors are different than predicted, the applicant needs <br />to monitor the backfilling and grading operations to determine whether the <br />approved post-mining topography is being achieved. The following stipulation <br />is therefore required: <br />THE APPLICANT SHALh SURVEY T1fE STOCKPILES, $ACKFZLLED AREAS, AfJD OPERATIONAL <br />PIT UTILIZING APPROPRIATE SCIRVEY TECIfNZQUES ONCE EA Clf 12 h1ONT115, IN ORDER Tn <br />VERIFY T7[AT THE OPERATIONS ARE ACIIZEVING TIII: APFROVF.D POST-hfINI1JG TOPOGRAPHY. <br />THE RESULTS OF T11E SURVEY SHALL $E SUDhf7TTEU TO TH F. DI VLSION AJJlJUALLY. <br />At the end of two 'years, the applicant may request in writiny that the Division <br />waive the survey requirements. The basis for the request shall be included in <br />writing. The Division will eraive this requirerrpnt once the applicant has <br />consistently demonstrated the overburden swell characteristics. <br />The applicant is proposing to stockpile spoil ercavated from the first cut in <br />two temporary stockpiles. Map hf-2 indicates the location of the stockpiles, <br />however, the scale is to small to identify the ycomctry of the pile. The <br />Division is concerned that an improperly constructed stockpile may be suseptable <br />to severe erosion and may slump onto the adjacent topsoil stockpiles. To <br />ensure. that this will not happen, the Division imposes the following stipulation: <br />WITHIN 120 DAYS OP PERMIT Z,SS UANCE T!!E APPLICANT S1JALh SUDf4IT DESIGN <br />INFORMATION FOR~TIIE PROPOSED TEMPORARY OVLiRIIURDEN STOCYPILES. THIS ILJFOR- <br />MATION SLIALL DESCRIDE T/lE GEOhiGTRk' (lIEZGIIT AND SLOPG APJGLE) OF <br />THE STOCKPILES AND TLIE h1ET11OD OF PLACEhfENT OF TILE MATERIAL. <br />With the acceptance of the above stipulations by the applicant, the Division <br />finds the operation in compliance. <br />XVIII. Mine Facilities, Coal handling Structures, Support Facilities, (2.05.3(3), <br />2.05.3(7), 9.04) <br />The mine facilities, support facilities, and coal handliny structures sections <br />Of the permit application have been reviewed by the, Di vision and are in compliance <br />with the Act and regulations. The mine facilities, coal handliny structures <br />and support facilities portions of the permit application are found in Volume 1 <br />pages 97-115 and Volume 2, Appendices N,O, and P. <br />
