C-S1-019 2005 Midterm Review <br />May 5, 2005 <br />Anticipated production levels started at 3 million tons per yeaz, and steadily rose thereafter to as <br />high as 5.8 million tons per yeaz. Coal production in tons per yeaz over the period of surface <br />operations (open pit, auger and highwall mining) is illustrated in the following graph. Annual <br />production is not expected to exceed 9 million tons in any one yeaz of the current 5-yeaz mining <br />plan. <br />Areas of initial mining in the East and Section 16 Pits, and all of the Section 11 Pit, have been <br />backfilled, graded to approved reclamation contour, and seeded. Other than on the West Pit <br />Excess Spoil Fill, no reclamation work has been accomplished on the recently-opened West Pit. <br />Notices of Violations Since November 5, 2002 <br />There were three notices of violations issued against Permit C-1981-019 since the fourth permit <br />renewal of November 5, 2002. <br />Notice of Violation CV 2003013 was issued October 29, 2003 with regazd to blasting procedures <br />in four parts. The violation was terminated on November 26, 2003. <br />Notice of Violation CV 2004001 was issued on June 22, 2004 with regazd to mining Federal coal <br />without appropriate approvals. One abatement action of several has not been completed at the <br />time of this review. <br />Notice of Violation CV 2004006 was issued on December 21, 2004 with regazd to failure to <br />timely notify the Division of suspected Colorado Dischazge Permit System exceedences. The <br />violation was terminated on December 21, 2004. <br />6 <br />
