Once NOFI decides to <br /> transfer ownership and take over the operation, we will work with them and you <br /> to facilitate this action. <br /> Be advised of the following 43 CFR regulations (in part) that pertain to your <br /> operation: <br /> Sec. 3809. 116 (a) <br /> (1) Mining claimants and operators (if other than the mining claimant) are <br /> jointly and severally liable for obligations under this subpart that accrue <br /> while they hold their interests. Joint and several liability, in this <br /> context, means that the mining claimants and operators are responsible <br /> together and individually for obligations, such as reclamation, resulting from <br /> activities or conditions in the areas in which the mining claimants hold <br /> mining claims or mill sites or the operators have operational <br /> responsibilities. <br /> (2) In the event obligations are not met, BLM may take any action authorized <br /> under this subpart against either the mining claimants or the operators, or <br /> both. <br /> (b) Relinquishment, forfeiture, or abandonment of a mining claim does <br /> not relieve a mining claimant' s or operator' s responsibility under this <br /> subpart for obligations that accrued or conditions that were created <br /> while the mining claimant or operator was responsible for operations <br /> conducted on that mining claim or in the project area. <br /> (c) Transfer of a mining claim or operation does not relieve a mining <br /> claimant' s or operator' s responsibility under this subpart for <br /> obligations that accrued or conditions that were created while the <br /> mining claimant or operator was responsible for operations conducted on <br /> that mining claim or in the project area until-- <br /> (1) BLM receives documentation that a transferee accepts <br /> responsibility for the transferor' s previously accrued <br /> obligations, and <br /> (2) BLM accepts an adequate replacement financial guarantee <br /> adequate to cover such previously accrued obligations and the <br /> transferee' s new obligations. <br /> Sec. 3809. 420 What performance standards apply to my notice or plan of <br /> operations? <br /> (10) Maintenance and public safety. During all operations and after <br /> mining— <br /> (i) You must maintain structures, equipment, and other facilities <br /> in a safe and orderly manner; <br /> (ii) You must mark by signs or fences, or otherwise identify <br /> hazardous sites or conditions resulting from your operations to <br /> alert the public in accord with applicable Federal and State laws <br /> and regulations; and <br /> (iii) You must restrict unaccompanied public access to portions of <br /> your operations that present a hazard to the public, consistent <br /> with Secs. 3809. 600 and 3712. 1 of this title. <br /> Sec. 3809. 424 What are my obligations if I stop conducting operations? <br /> (a) To see what you must do if you stop conducting operations, follow <br /> this table: <br />
