. ~ November 9 Order, to "continue to pay nll amounts due on account <br />of [the Post-September 1985 Claims], as such claims become due, <br />whether such claims have been determined or adjudicated or are <br />determined or adjudicated in the future." Nevertheless, since <br />the time the Self-Insured Debtors commenced their respective <br />bankruptcy cases on November 7, 1990, all action with respect to <br />Post-September 1985 Claims which have not yet been determined or <br />adjudicated has been stayed pursuant to 11 U.S.C. § 362. As a <br />result, the known claims listed on Exhibit 1 have stopped moving <br />toward resolution, hearings have been continued, closed cases <br />have not been reopened, and no new Post-September 1985 Claims <br />have been asserted. <br />12. The Self-Insured Debtors believe that, in light of the <br />November 7__Order-and the November 9 Order authorizing payment of <br />all Post-September 1985 Claims, it is appropriate and necessary <br />to lift the automatic stay with respect to all Post-September <br />1985 Claims to allow such claims to be resolved in the ordinary <br />course, subject to the limitations and requirements of the <br />Colorado Act and other applicable statutes and rules of procedure <br />and practice. The Self-Insured Debtors believe that failure to <br />obtain relief from the automatic stay may jeopardize their <br />ability to self-insure for workers' compensation under the <br />Colorado Act. Permission for self-insurance may be revoked at <br />any time by the executive director who has the sole power to <br />prescribe the rules, regulations, orders, terms and conditions <br />upon which said permission may be granted or continued.
