Mr. Jim Tatum <br />-2- August 12, 1993 <br />services of a qualified plumbing contractor to lower the elevation of the retrofitted gravity- <br />style sump pit drain so that it drains the pit from the bottom/side, provide continuous '/." <br />slope per foot and discharges beyond the bank north of the home." <br />Your July 12, 1993 letter states, "No evidence exists that any surface water ponding exists <br />around the entire building perimeter as you state. The lawn that surrounds the house <br />doesn't bear out this statement." In fact, the March 8, 1993 report which you <br />commissioned states the following: <br />a. "The courtyard, on the most southern side of the building, appears <br />to have a negative slope toward the building. In addition, areas of <br />water oondino exist around the entire building perimeter which <br />contributes to localized subsidence/compaction of the soils near the <br />foundation." (Page 3; emphasis added); <br />b. "Photograph 3 -There appears to be negative slope within the <br />courtyard from the wall/fence back toward the dwelling. If not <br />corrected, this condition will allow water ponding adjacent to the <br />foundation, cause subsidence of soils, and create the potential for <br />water seepage into the lower levels of the home." (Page 5); <br />c. "Photograph 5 -The small arrows point in the direction surface <br />runoff water is believed to flow and pond next to the buildings' <br />foundation. The large arrow shows the ideal direction surface <br />water should flow." (Page 6). <br />In addition to these comments regarding the main structure, comments regarding ponded <br />water around the bunkhouse were provided in the March 8, 1993 report as well. On <br />page 18, the report states: "Photographs 1-4 -Various views of the bunkhouse. Note the <br />water ponding area in photo 3, at or near the most northeast corner of this building..." <br />The Division has reviewed the information which you have submitted and has rendered its <br />opinion. Although you may disagree with the findings of your report, we must evaluate all <br />information available. <br />Regarding your concerns with Basin Resources' misrepresenting to the Division the location <br />of the underground mine workings, the only factual basis the Division has in determining <br />extent of any underground operation is from information provided by operators. <br />During the winter of 1992-93, the Division observed some of the pine trees near the fan <br />turning brown. During inspections held this summer, we have observed all but one of the <br />trees returning to their normal color. The one tree 50 feet from the fan has as yet not fully <br />recovered. As we have stated before, concerns regarding air emissions should be discussed <br />with the Air Pollution Control Division of the Colorado Department of Health, as they are the <br />agency responsible for issuing air emissions permits.
