Long <br />Drvivon D"tY'IOr <br />Thank you for providing your letter of July 12, 1993 regarding your concerns with your <br />adobe structure situated adjacent to the Purgatoire River in Las Animas County. Your letter <br />also mentioned additional concerns with vegetation in the proximity of the Golden Eagle <br />Mine exhaust fan. We would like to take this opportunity to provide our responses. <br />We believe your statement that there "appears to be an effort to cover up the facts in this <br />matter." is both inaccurate and unjustified. The Division has since November 1992 been in <br />contact with your office, officials from Las Animas County government, representatives <br />from various State agencies, and representatives from Basin Resources in addressing your <br />concerns. Our responses have been derived from public files located in our offices, from <br />our field inspections, which are well documented, from discussions with various private and <br />public representatives, and from information submitted by your office. At no time has any <br />part of our investigation been conducted in a manner that would imply anything but full and <br />complete disclosure. <br />Your letter states that, with regard to our review of the reports you provided in your <br />May 25, 1993 letter, the Division's observations regarding your boiler and sump drain are <br />"speculation," "untruthful," and "inaccurate." Our conclusions were derived directly from <br />the March 8, 1993 report from Colorado Real Estate Inspection Services, Inc., which you <br />submitted to the Division. Page 4 of that report states that "water in the sump pit was <br />clear, making us question if there is a leak in the potable water supply or piping, which <br />could be replenishing the sump pit...The Foreman present during this inspection was asked <br />how often water is added to the boiler. His reply was 'daily.' This frequency of adding <br />water to a boiler is highly irregular, unless there is a leak in the boiler's piping system which <br />could also be a source of replenishment of sump pit." <br />With regard to both of these items, the March 8 report on page 2 recommends the follow- <br />ing: "retain the services of a qualified hydronic heating contractor to conduct a pressure <br />test on the boiler and its distribution lines and make the necessary repair," "retain the <br />services of a qualified plumbing contractor to pressure test the water pipe inside the building <br />and all exterior water hydrants for leakage and make the necessary repair," and "retain the <br />
