Stipulation No. 6 <br />THE PERMITTEE WILL SUBMIT TO THE DIVISION AN ANNUAL HYDROLOGIC REPORT. <br />THIS REPORT SHALL INCLUDE AN ANALYSIS OF ALL HYDROLOGIC DATA GATHERED <br />DURING THE YEAR, AN ASSESSMENT OF THE HYDROLOGIC IMPACTS OF MINING DURING <br />THE YEAR, AND AN ASSESSMENT OF THE PROJECTED HYDROLOGIC IMPACTS OF MINING <br />IN THE FOLLOWING YEAR. THIS REPORT SHALL ASSESS THE IMPACTS OF MINING ON <br />THE QUALITY AND QUANTITY OF WATER IN SURFACE STREAMS, SPRINGS, GROUND <br />WATER AQUIFERS, MINE INFLOW, AND MINE DISCHARGES. <br />Stipulation No. 21 <br />BEAR COAL COMPANY SHALL MONITOR'BOTH THE OPERATIONAL AND RECLAIMED <br />CONFIGURATIONS OF THE PORTAL ASSESS ROAD AND PORTAL FACILITIES OF THE NO. <br />3 MINE. MONITORING SHALL CONTINUE ON A SEMI-ANNUAL BASIS UNTIL TWO YEARS <br />FOLLOWING COMPLETION OF THE RECLAMATION OF THE PORTAL ACCESS ROAD AND <br />PORTAL FACILITY AREA. RESULTS OF THE MONITORING SHALL BE SUBMITTED TO <br />THE DIVISION WITHIN 30 DAYS FOLLOWING COMPLETION OF EACH MONITORING <br />EPISODE. <br />Stipulation No. 30 <br />BEAR COAL COMPANY WILL CONTINUE TO WORK WITH THE DIVISION IN DERIVING A <br />REVISED BOND ESTIMATE PURSUANT TO THE PROCEDURES OF 3.02, AS INITIATED <br />DURING THE RENEWAL REVIEW. <br />The renewal application was submitted by Bear Coal Company for the mine. This <br />decision is based on a finding that the operations will comply with all <br />requirements of the Colorado State Program as found in the Colorado Surface <br />Coal Mining Reclamatlon Act, C.R.S. 34-33-101 et seq., and the Regulations <br />promulgated pursuant to the Act. If no request for a formal hearing is made <br />within thirty (30) days of the first publication of the issuance of this <br />proposed decision, then this decision becomes final. The permit application, <br />all supporting documentation and any stipulations or conditions will become a <br />binding part of the permit. <br />Summary <br />The Review Process <br />The Bear Coal Company operations currently consist of one active underground <br />mine (Bear No. 3), and two inactive mines that have been reclaimed (Bear No. <br />and 2). The mining operation is located approximately ten miles northeast of <br />Paonia, Colorado, and one-quarter mile east of Somerset, Colorado (Figure i). <br />The mining area is located adjacent to the North Fork of the Gunnison River <br />(North Fork). The Bear Mine has been in continuous operation since 1934. <br />Annual average production ranges from 250,000 to 320,000 tons of coal, which <br />are extracted from the "C" seam within Federal Coal Leases D-052502 and <br />C-0117192, at the Bear No. 3 Mine. "B" seam mining was approved with <br />technical revision No. 3. Areas of approximately 19 acres and eight acres <br />have been disturbed at the Bear No. 1 and 2, and at the Bear No. 3, <br />respectively. the original permit C-81-033 was issued on July 19, 1982. <br />-2- <br />
