Introduction This document is the decision package prepared by the Colorado Division of Minerals and Geology (Division) for the Bear Coal Company, Mine Nos. 1, 2, and 3. This document includes: (1) The proposed decision to approve with stipulations the permit renewal; (2) A summary which includes a history of the review of the permit renewal application, a description of the environment affected by the operation, and a description of the mining and reclamation plan; and (3) The written findings of compliance the Division has made as required by the Colorado Surface Coal Mining Reclamation Act. Detailed information concerning the findings of compliance can be found in the Regulations of the Colorado Mined Land Reclamation Board for Coal Mining. The Division received an application for a permit renewal to conduct surface cal mining and reclamation operations at the Bear Coal Company, Mine Nos. 1, 2, and 3. The application was submitted by Bear Coal Company, and the mine will be operated by Bear Coal Company. The mine is located on and/or under federal and private lands within Gunnison County, Colorado. The legal description of the sands included within the permit area is: Township 13 South. Ranoe 90 West. 6th P.M. Section 8: S/2 SE/4 South of River Section 9: S/2 S/2 South of River Section 16: All Section 17: All except portions of the N/2 NW/4, NW/4 NE/4, W/2 SW/4 Section 20: N/2 N/2 NW/4, NE/4, E/2 NW/4 Section 21: N/2 NE/4, N/2 NW/4, SW/4 NW/4 Proposed Decision The Colorado Mined Land Reclamation Division proposes to approve with stipulations the renewal of a valid, existing permit. A record of all previously required permit stipulations can be found within the Division files. All stipulations which are not attached to this Permit Renewal approval have been previously satisfied. The current Permit Renewal approval includes the following stipulations: Stipulation No. 4 THE APPLICANT SHALL CONTINUE TO SUBMIT TO THE DIVISION AN ANNUAL REPORT OF INFLOWS, DISCHARGES AND CONSUMPTION OF WATER WITHIN THE MINE. THIS REPORT WILL INCLUDE A MINE WORKINGS MAP WHICH SHALL CONTAIN THE SOURCE (I.E., FAULT, FRACTURES, ETC.), QUANTITY, DURATION, AND QUALITY OF MINE INFLOWS, AND A TABLE CONTAINING RECORDS OF WATER DISCHARGED FROM THE MINE, CONSUMED IN THE MINE AND IMPORTED FOR USE WITHIN THE MINE WILL ALSO BE INCLUDED.
