December 1, 1993
Page 2
appears that this was done.
What possible difference can it make that my letter was
dated after the original mine permit was issued in 1984 and
the permit expansion of 1990? If a well and windmill tower
were left off the original inventory and permit, this must
have been deliberate in light of the obvious presence of the
well.
I don't have a map that shows the well location. I
also didn't drill the well so I don't know its depth. I
bought the land and well in 1988, so I don't know the
historic water level. The well was first observed as being
dry after the air shaft was drilled. The amount of water
the well previously produced was sufficient to provide stock
water for the pasture in which it/ was located for many
years.
It is now obvious that we need to bring you and Mr.
Dudash down here to be examined under oath. Please have the
attorneys who will represent you contact me and we will try
to schedule this deposition by agreement so as to minimize
inconvenience to everyone.
Very truly yours,
JI~TATUI~ AND ASSOCI
tum
JT/ah
cc: Robert Krassa FA (303) 443-3617
Michael Ossola FAX (719) 846-8666
