If so, <br />please furnish us with a copy of this report. <br />Contrary to Wyoming Fuel's earlier assertions, we now <br />know that elevation monuments were made and measurement's <br />taken regarding movement close to the Tatum house. The <br />Colorado Statutes call for such elevation markers and <br />periodic monitoring reports. Please furnish these reports. <br />We earlier supplied you with a copy of my letter to <br />Robin Forte regarding the effect of the air shaft on my <br />water well. I don't see that this well was listed on the <br />structure inventory filed by the mine before working under <br />this property. Please explain how a well and windmill tower <br />can be omitted or fail to be seen. The mine cannot claim <br />that they nad no knowleage of such ciell of*_er they ~•:ere <br />advised of same in writing. <br />Your correspondence indicates that you are continuing a <br />course of dilatory tactics with the ultimate aim of not <br />upholding the State of Colorado's law and regulations. <br />1. There was no lease executed between me and KN Energy <br />whereby they drilled the air shaft. You were furnished a <br />copy of our letter to Robin Forte which certainly put <br />everyone on notice of this well and possible damages from <br />the proposed air shaft. You now appear to be trying to find <br />some possible justification for the fact that this well is <br />now dry. Certainly a 14 Ft. air shaft next to the well could <br />reasonably be expected to drain the water strata and it <br />
