On July 18, 1986 the Division received a second permit renewal application that was deemed <br />complete on August 7, 1986. A preliminary adequacy review was completed by the Division on <br />September 30, 1986. The correspondence of October 27 and November 24, 1986 in response to <br />the adequacy review resolved all the Division's concerns raised during the renewal process. <br />A review of past permit renewals showed that the length of the second permit term exceeded 5 <br />years. The original permit was issued December 1, 1981 and the expiration date for this permit <br />was the anniversary date plus 5 years, or December 1, 1986. During the renewal, Canadian had <br />the right of successive renewal and the renewal date passed. The problem arose because the <br />Division issued the next 5 yeaz permit term from May 16, 1987 and not from December ], 1986. <br />Thus the right of successive renewal allowed for a greater than 5 year permit term. The Division <br />should have issued the renewal from December 1, 1986. The Division reset the permit expiration <br />date to the original anniversary date of December 1. The third permit term expired on December <br />1, 1996. <br />Slurco submitted the permit renewal application 180 days in advance of the permit expiration <br />date, thus ensuring Slurco's right of successive renewal, as per Rule 2.08.5(2). <br />The current permit term will expire on December 1, 2001. <br />Permit Revisions During Last Permit Term: <br />Technical Revision No. 7 <br />Approved with conditions on December 12, 1994. This revision addressed modifications and <br />clazifications to the design hydraulics on permanent Ponds Nos 1 and 2. Stipulation No. 33 was <br />attached to the permit as a condition of the approval of this revision. <br />Technical Revision No. 8 <br />Approved May 22, 1996. This revision reduced the woody plant density success standard to 500 <br />stems per acre. <br />Minor Revision No. 7 <br />Approved April 19, 1994. This revision changed the annual due date for submittal of Rill and <br />Gully reports to July 31st. <br />Minor Revision No. 8 <br />Approved November 10, 1994. This revision provided for termination of Stipulation No. 32 by <br />incorporation of spoil well data into the annual hydrologic report. <br />Canadian Strip Mine, C-81-026 5 December 5, 1996 <br />
