SUMMARY <br />The Renewal Review Process <br />On March 11, 1996 the Colorado Division of Minerals and Geology notified Slurco Corp. that <br />the permit, No. C-81-026, would expire December 1, 1996. This notification was given pursuant <br />to Rule 2.08.5(2)(a). This Rule requires [hat the Division to notify the permittee 270 days before <br />the expiration of permit. The applicant, [o be eligible for the right of successive renewal, must <br />submit a renewal application within 180 days of the expiration of the expiration of the permit. <br />The 180 day date for the Canadian Strip Mine was June 4, 1996. The Division received a <br />complete application for a renewal on April 4, 1996. The applicant, therefore, met the conditions <br />for the right of successive renewal. <br />Adequacy review concerns for the permit renewal were submitted to Slurco on September 24, <br />1996 and on November 25, ]996. Most of the concerns have been adequately resolved. Those <br />issues which remain outstanding have been stipulated in Stipulation No. 34. <br />Before issuing a renewal of a permit, the Division must conduct a compliance status review of <br />the owners and operators of the mining operation. Slurco does not have any other coal mining <br />operations in other states. Therefore, no other state programs were contacted. As part of the <br />renewal, a check with the Office of Surface Mining Reclamation and Enforcement (O.S.M.R.E.) <br />Applicant Violator System (A.V.S) was conducted on June l9, 1996, October 4, 1996 and <br />December 4, 1996. Each query resulted in the O.S.M.R.E. issuing a recommendation to approve. <br />Permitting History for Previous Permit Terms <br />On February 11, 1981, Wyoming Fuel Company, a division of Kansas-Nebraska Natural Gas <br />Company, filed an application with the Colorado Division of Mined Land Reclamation and the <br />federal Office of Surface Mining to continue and expand its existing operations at the Canadian <br />Strip Mine site. Permit C-81-026 was issued to the Wyoming Fuel Company for the Canadian <br />Strip Mine on December 1, 1981. <br />On June 28, 1982, the Division received a notice of temporary cessation of mining activities from <br />the Wyoming Fuel Company. No coal has been mined at the mine since then. <br />In accordance with Rule 2.08.5 of the Regulations, the Division notified Wyoming Fuel Company <br />that a permit renewal application was required to be submitted to the Division by June 1, 1986. <br />On June 3, 1986, the Division received a permit renewal application that was deemed incomplete <br />on June 4, 1986. <br />Canadian Strip Mine, C-81-026 4 December 5, 1996 <br />
