habitat and rangeland for cattle grazing prior to mining operations. Under the applicant's <br />approved reclamation plan, the land will be returned to equal or better utility for these <br />same uses. Post-mining land use will be wildlife habitat and rangeland. <br />Ponds Nos. 1 and 2 are being retained as permanent structures at the mine site, per <br />Technical Revision No. 6, approved by the Division in August, 1991. Landowners <br />requested retention of these ponds and filed for the associated water rights, in recognition <br />that the pond's retention would enhance the post-mining land use per Rules 4.16.1(2) and <br />4.16.2(1). The operation is in compliance with the requirements of this section. <br />14. Specific approvals have been granted. These approvals are addressed in the following <br />section, Section B. (2.07.6(2)(m)). <br />15. The Division finds that the activities proposed by the applicant would no[ effect the <br />continued existence of endangered or threatened species or result in the destruction or <br />adverse modification of their critical habitats. (2.07.6(2)(n)). <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As <br />of December 4, 1996, the operator is current in the payment of reclamation fees required <br />by 30 CFR Chapter V[I, subchapter R. (2.07.6(2)(0)).
