The approved plan specified that topsoil and subsoil would be moved <br />to the Halt Pit and stored in separate stockpiles for future reclamation. While some topsoil was <br />initially moved to the Hall Pit, much of it was pushed into the western edge of Block 2, creating <br />anew 150' wide area of disturbance. Some topsoil was also pushed into the visual buffer zone, <br />Some subsoil was pushed into the eastern edge of Block 9. Most of the subsoil was moved to the <br />Hall Pit and covered up whatever topsoil had been present. <br />As a result of the soil handling procedures, some topsoil was lost, some may have mixed with <br />"K' subsoil, and most of the topsoil will require double handling. These procedures will adversely <br />affect Long-term reclamation potential. <br />In order to resolve the noncompliance issues, United agreed to submit a modification to the <br />mining and reclamation plan and proceed with a new sales contract for Block 2. You indicated <br />that stripping activities on Block 2 could commence as soon as this September. As such, we <br />anticipate that your modification to the mining and reclamation plan will be submitted in the near <br />future, and a new sales contract will be prepared. The plan modification should be submitted by <br />September 1, 2002, and the new sales contract approved by September 3Q 2002. If these <br />deadlines are not met, this office will require that corrective actions be completed within 30 days <br />to correct the noncompliance activities identified above. Specifically, the following procedures <br />and requirements should be addressed in the modification: <br />
