III IIIIIIIIIIIIII~ <br />999 <br />To: Jim Stevens <br />CC: Larry Routten <br />From: Sandy Brown <br />Date: 12/02/98 <br />Re: City of Florence -Proposed Oak Creek Storage Reservoir <br />The Southfield Loadout is within the area of the proposed Oak Creek Storage <br />Reservoir. The Loadout is located approximately one mile south of Florence and is <br />described as follows: <br />NW'/a Section 17, NE'/a Section 18 T19S R 69W of the 6`h P.M. <br />The permitted acreage is 22 acres of which 14 acres were disturbed and reclaimed. <br />The proposed reservoir will inundate the west side of the Loadout. <br />Backfilling and grading of [he Loadout was completed in October, 1996. Energy <br />Fuels Company Inc. (EFCI) removed all coal stockpiles from [he Loadout prior to <br />regrading. Any coally materials remaining in the footprints were buried in the <br />deeper parts of the fill areas during backfilling and grading. All structures were <br />removed at the Loadout except the railroad tracks and two small sediment ponds. <br />The railroad tracks are approved for permanent retention. They are owned by The <br />Atchison, Topeka, and Santa Fe Railway Company. <br />A Phase I bond release was approved January 2, 1998. Michael J. Markus, the <br />Florence City Planner, participated in the bond release inspection conducted on <br />October 1, 1997. As explained to Mr. Markus during the bond release review, (letter <br />dated September 3, 1997) EFCI has monitored surface water quality and quantity on <br />Oak Creek downstream of the Loadout facility since 1983, and will continue to do so <br />until at least the spring of 2007, the end of the minimum ten year liability period. <br />Monitoring to date indicates no negative impacts on Oak Creek attributable to the <br />Loadout operation relative to the parameters measured. <br />The September 3, 1997 letter to Mr. Markus describes the bond release process and <br />explains [hat EFCI may change the post mining landuse if the proposed reservoir is <br />built. A change in the post mining land use could eliminate the ten year liability <br />period. <br />
