-13- <br />Stipulation PR 2: <br />BY SEPTEMBER 15, 1984 THE PERMITTEE WILL SUBMIT TO THE DIVISION, COST <br />ESTIMATES FOR RECLAMATION OF THE WORST CASE SCENARIO AT THE HAYDEN GULCH <br />MINE DURING THE REMAINING LIFE OF THE MINE. THESE COST ESTIMATES WILL BE <br />ACCOMPANIED BY A MINE PLAN MAP DEPICTING THE WORST CAST SCENARIO: TABLES <br />OF AMOUNTS AND LOCATIONS OF MATERIAL TO BE REPLACED AND/OR MOVED: RENTAL <br />RATES BASED ON 1984 RENTAL RATE BLUE BOOK COSTS, PRODUCTION RATES BASED <br />ON THE CATERPILL P F RMANCE HAND K ED. 3 OR NEWER) OR OTHER <br />MANUFACTURER PRODUCTION HANDBOOK, AND CONSTRUCTION COSTS BASED ON THE <br />MEANS CONSTRUCTION COST DATA PUBLICATION, OR OTHER PUBLISHED COST DATA. <br />With the acceptance of this stipulation the permittee will be in compliance <br />with the requirements of this section. <br />XVI. Operations on Lands Subject to Limitations or Prohibitions -Rules <br />The proposed operation is in compliance with the requirements of these <br />sections and 2.07.6(2)(d) for the following reasons: <br />1. The permit area of the proposed operation is not within: <br />a. An area designated unsuitable for mining; <br />b. An area under study for designation as unsuitable for surface <br />coal mining; <br />c. On any lands subject to prohibitions or limitations; and <br />d. Within 300 feet of any occupied building. <br />2. The proposed operation is within 100 feet, measured horizontally, of <br />County Road 53. However, the Division finds that the operation is <br />relieved of this requirement on the basis of valid rights existing <br />prior to August 3, 1977 in the form of a sales contract for the coal <br />to be mined which was signed July 25, 1911. <br />Division staff has contacted <br />the proximity of the mine to <br />the concerns with respect to <br />use permit from the county o <br />Office staff indicated there <br />to the county road. <br />the Routt County Planning Office with respect to <br />County Road 53. HG Coal Company satisfied all of <br />public review and comment and received a special <br />i September 27, 1977. The Routt County Planning <br />would be no problem with the operation relative <br />The operation is in compliance with the requirements of this section. <br />XVII. Demonstration that Surface Coal Mi <br />eas <br />Contingent upon the satisfactory resolution of the stipulations presented in <br />the findings document, the following finding of compliance is valid. <br />The Division finds, pursuant to Rule 2.07.6(2)(b), based on information in the <br />application and from all available sources, that surface coal mining and <br />reclamation operations can be feasibly accomplished under the Mining and <br />Reclamation Plan contained in the application. <br />The operation is in compliance with the requirements of this section. <br />
