_lp_ <br />The permit revision as originally submitted showed a post-mining topography <br />with oversteepened slopes on the southern limit of mining. The post-mining <br />topography also proposed channelized surface flow with steep gradients. The <br />applicant was requested to submit a map of the final reclaimed surface which <br />would demonstrate conformance with AOC and which would prove the final surface <br />to be geomorphically stable. With the exception of the following described <br />area, the applicant's response to this request was adequate. <br />The Division has concerns over one area of the proposed post-mining <br />topography. This area is located on a point 50 feet southeast of the <br />intersection of N378,000 Adj. and E1,498,000 Adj.; this point defining a line <br />extending 300 feet southwest and 200 feet northeast. The post-mining <br />topography map (Exhibit 1 of Response to Adequacy Issues for the Permit <br />Revision) shows a steep slope in this area which the Division believes may be <br />subject to erosion above the norm for the area. Therefore, the following <br />stipulation is required. <br />Stipulation PR l: <br />THE APPLICANT WILL SUBMIT TO THE DIVISION WITHIN 45 DAYS OF PERMIT <br />REVISION APPROVAL, A PLAN SUFFICIENT TO CONTROL EROSION OFF THE STEEP <br />SLOPE OF THE AREA ADJACENT TO THE INTERSECTION OF N378,000 ADJ. AND <br />E1,498,000 ADJ. <br />With the acceptance of the above stipulation, the operation is in compliance <br />with the requirements of this section. <br />XIV. Mine Facilities, Coal Handling Structures, Support Facilities - Rules <br />The mine facilities, coal handling structures, and support facilities sections <br />of the permit application have been reviewed by the Division. The mine <br />facilities and support facilities portions of the permit application can be <br />found in Section 2.05.3(Volume I), Appendix E (Volume III), Appendix N (Volume <br />V), and Appendices 0, P, and Q (Volume VI ). Information concerning coal <br />handling facilities can be found in Section 2.05.3 (Volume I). <br />No proposed changes in the mine facilities, coal handling structures, or <br />support facilities were proposed in this revision. <br />The operation is in compliance with the requirements of this section. <br />XV. Bonding - Rules 2.05.4(2)(b) and 3 <br />The permittee currently has a reclamation bond in the amount of $ 2,223,313.00 <br />filed with the Division. <br />The Division has reason to believe that the reclamation cost estimates <br />presented by the permittee in the original permit application no longer <br />reflect conditions at the mine, since the worst case condition was based on <br />the mining configuration in 1982. Therefore, the following stipulation is <br />required: <br />
