Findings of the <br />Colorado Mined Land Reclamation Division <br />for the Reouest to Transfer <br />Permit No. C-81-023 to <br />Kaiser Stee] Corporation <br />Explanation of Findings <br />Pursuant to Rule 2.08.6(4) of the Rules and Regulations of the Colorado Mined <br />Land Reclamation Board for Coal Mining and the approved State Program, the <br />Division must make written findings prior to granting approval of any <br />succession of operators and transfer of permit. These findings are based on <br />information made avai]able to the Division that demonstrates the applicant <br />will be able to operate in compliance with the Colorado Surface Coal Mining <br />Reclamation Act and the Regulations promulgated pursuant to the Act. These <br />findings are organized according to Rule 2.08.6. <br />I. Rule 2.08.6(4)(a) - Compliance with the Act and Promulgated Regulations <br />Based on information submitted in Section 2,03.5 of the transfer request <br />application, the Division finds that Kaiser Steel Corporation does not own or <br />control any operations which are currently in violation of any law, rule, or <br />regulation of the United States, or any state law, rule or regulation enacted <br />pursuant to federal law, rule or regulation pertaining to air or water <br />environmental protection, or of any provision of the Federal Surface Mining <br />Control and Reclamation Act or the Colorado Surface Coal Mining Reclamation <br />Act pursuant to Rule 2.07.6(2)(8). <br />The Division finds that Kaiser Steel Corporation does not control and has not <br />controlled mining operations with a demonstrated pattern of willful violations <br />of the Att of such nature, duration, and with such resulting irreprable damage <br />to the environment to indicate an intent not to comply with the provision of <br />the Act pursuant to Rule 2.07.6(2)(h). <br />The applicant has provided an identification of interests as required by Rule <br />2.03.4. <br />The applicant is in compliance with the requirements of this section. <br />II. Rule 2.08.6(4)(b) - Performance Bond <br />Kaiser Steel Corporation submitted a replacement performance bond for <br />5800,000.00 on June 25, 1986. This replacement performance bond was jointly <br />executed by Kaiser Steel Corporation and Bechtel Operating Services <br />Corporation. This performance bond replaces a previously posted 5800,000.00 <br />performance bond for the Chimney Rock Coal Mine. The Division accepted this <br />replacement performance bond on July 21, 1986. <br />The applicant is in compliance with the requirements of this section. <br />
