Findings of the Colorado Mined Land Reclamation Division for the Reouest to Transfer Permit No. C-81-023 to Kaiser Stee] Corporation Explanation of Findings Pursuant to Rule 2.08.6(4) of the Rules and Regulations of the Colorado Mined Land Reclamation Board for Coal Mining and the approved State Program, the Division must make written findings prior to granting approval of any succession of operators and transfer of permit. These findings are based on information made avai]able to the Division that demonstrates the applicant will be able to operate in compliance with the Colorado Surface Coal Mining Reclamation Act and the Regulations promulgated pursuant to the Act. These findings are organized according to Rule 2.08.6. I. Rule 2.08.6(4)(a) - Compliance with the Act and Promulgated Regulations Based on information submitted in Section 2,03.5 of the transfer request application, the Division finds that Kaiser Steel Corporation does not own or control any operations which are currently in violation of any law, rule, or regulation of the United States, or any state law, rule or regulation enacted pursuant to federal law, rule or regulation pertaining to air or water environmental protection, or of any provision of the Federal Surface Mining Control and Reclamation Act or the Colorado Surface Coal Mining Reclamation Act pursuant to Rule 2.07.6(2)(8). The Division finds that Kaiser Steel Corporation does not control and has not controlled mining operations with a demonstrated pattern of willful violations of the Att of such nature, duration, and with such resulting irreprable damage to the environment to indicate an intent not to comply with the provision of the Act pursuant to Rule 2.07.6(2)(h). The applicant has provided an identification of interests as required by Rule 2.03.4. The applicant is in compliance with the requirements of this section. II. Rule 2.08.6(4)(b) - Performance Bond Kaiser Steel Corporation submitted a replacement performance bond for 5800,000.00 on June 25, 1986. This replacement performance bond was jointly executed by Kaiser Steel Corporation and Bechtel Operating Services Corporation. This performance bond replaces a previously posted 5800,000.00 performance bond for the Chimney Rock Coal Mine. The Division accepted this replacement performance bond on July 21, 1986. The applicant is in compliance with the requirements of this section.
