On January 7, 1983, the Division issued Coal Permit No. C-81-023 to Chimney
Rock Coal Company. This permit is fora five-year term and expires on January
7, 1988.
In April, 1985, Kaiser Steel Corporation acquired the Chimney Rock Coal Mine
from Chimney Rock Coal Company.
During the mid-term review, the Division determined that Kaiser Steel
Corporation had not submitted the required information pursuant to Rule
2.08.6. The Division's February 18, 1986 correspondence requested legal,
financial, and compliance information required pursuant to Rule 2.08.6 be
submitted by April 1, 1986.
On April 1, 1986, the Division received information pursuant to Rule 2.08.6
from Kaiser Steel Corporation.
On April 30, 1986, the Division sent a correspondence to Kaiser Steel
Corporation requesting the execution of a "Request for Transfer of Coal Permit
and Succession of Operators" document.
On July 3, 1986, the Division received a properly executed "Request of
Transfer of Coal Permit and Succession of Operators" document from Kaiser
Steel Corporation.
On July 14, 1986, the Division deemed the submitted information complete and
commenced adequacy review.
On July 25, 1986, the Division received the most current Form lOK from Kaiser
Steel Corporation. The Form lOK was reviewed during the Division's adequacy
review process.
On July 31, 1986, Kaiser Steel Corporation had a public notice published in
the Pagosa S rings Sun pursuant to Rule 2.08.613). No comments were received
during t e r teen ) day comment period.
On August 19, 1986, the Division sent compliance status request forms to the
State of New Mexico, the State of Utah, the Office of Surface Mining and the
Colorado Department of Health. Comments were received from each of these four
(4) agencies during the thirty (30) day comment period with no problems noted.
The Division has thoroughly reviewed the various information submitted by
Kaiser Steel Corporation as a basis for this decision.
