Hernandez 2 October 19, 1992 <br />During the last month, a number of documents were examined to ascertain the source of <br />coal waste near the tipple pond and in the drainage, as well as the source of the shale. As <br />the Division is obligated to reclaim solely those areas disturbed by G.E.C., determination of <br />the source of this coal waste was deemed significant. USGS 1983 <br />The Division's research found that the MLRD inspection reports contained very few <br />specifics about Section 24. The Division aerial photos post-dated the initiation of G.E.C.'s <br />activities at the site and thus provided little insight to the investigation. <br />Research into the Mined Land Reclamation Board meeting minutes found that G.E.C. first <br />appeared before the Board in October, 1978. Over the next year, G.E.C. was before the <br />Board almost monthly for discussions regarding the mining plan and a possible <br />amendment, the existing bond amount, the relationship of reclamation obligations within <br />the G.E.C. leases to the G.E.C. permit, and miscellaneous enforcement actions. <br />
