Long <br />Division Director <br />Summary <br />The Division is currently in the process of developing a Reclamation Bid Document for the <br />reclamation of the Section 24 portion of GEC Minerals Permit No. C-81-037. During this <br />process, a difference of opinion developed between the Division and the landowner <br />regarding the reclamation liability for certain mine waste piles in the east half of Section <br />24. Numerous sources were examined to ascertain the source of this mining waste, as <br />mining in this area has been attributed to no less than five underground operations and <br />two strip mining operations. <br />Three waste deposits totalling less than 3 acres in extent were critically examined: the <br />coal waste piles north and west of the tipple pond, the coal in the drainage between the <br />tipple and the Orphan Pit, and the shale pile adjacent to the tie-across haul road. <br />The result of this portion of the Division's investigation finds that the GEC reclamation <br />responsibility for these mine waste piles is restricted to the road that passes over the coal <br />in the drainage between the tipple and the Orphan Pit, and to the coal waste piles that lie <br />west of the tipple pond. All other coal waste associated with these deposits appear to <br />have existed prior to GEC's involvement, and will thus not be included in the current Bid <br />Document package. <br />Description of Investigation <br /> <br />On September 10, 1992, Cathy Begej inspected the G.E.C. permit area with the <br />landowner, Dr. W.D. Corley. The objective of this inspection was to review the <br />reclamation plans associated with the July 10, 1992 Bid Document. During this <br />inspection, Dr. Corley indicated that certain mine waste that lay north and west of the <br />tipple pond had been placed there by the Corley No. 6 mine, while the Division had <br />historically attributed this material to G.. E.C. In addition, Dr. Corley asserted that a portion <br />of the material in the drainage between the tipple and the Orphan Pit was attributable to <br />G.E.C., as was a pile of shale east of the Orphan Pit. <br />
