Additionally, since the mine has been reclaimed, no additional areas are to be affected; <br />therefore, there is no potential for additional impacts to alluvial valley floors. The <br />operation is in compliance with the requirements of this section. <br />Please refer to Section B, VIII, of this document for a more detailed discussion of alluvial <br />valley floors. <br />13. The Division hereby approves the post-mining land use of the operation. It was deter- <br />mined that rangeland and wildlife habitat meets the requirements of Rule 4.16 for the <br />permit area. An alternative post-mining land use was also approved by the Division, <br />based on use of some mine facilities in hunting and fishing guide operations, and on the <br />landowner's request for retention of those facilities (2.07.6(2)(1)). <br />14. Specific approvals have been granted or are proposed. These approvals are addressed in <br />the following section, Section B (2.07.6(2)(m)). <br />15. The Division fmds that the activities proposed by the applicant would not affect the <br />continued existence of endangered or threatened species or result in the deswction or <br />adverse modification of their critical habitats (2.07.6{2){n)}. <br />16. The Applicant Violation System (AVS) was queried on November 3, 1994 and <br />December 14, 1494. The AVS recommendation was "Deny," based on an association <br />between a former Enron officer and Oklahoma Public Service. As of December 21, <br />1994, OSM recommended permit issuance based on updated ownership and control <br />information. <br />As of this time, Enron Coal Company, the operator, is current in the payment of <br />reclamation fees required by 30 CFR Chapter VII, subchapter R (2.07.6(2)(0). <br />Section B <br />The following fmdings and specific approvals are required by Rule 4: <br />I. Roads <br />A. Haul Roads <br />The Division proposes to approve the retention of the haul road depicted on <br />Exhibit C-7 in the permit application package s'mce it is compatible with the <br />approved post-mining land use, and a request for its retention was submitted by the <br />landowner (4.03.1(1)(f)(i)). <br />B. Access Roads <br />The landowner has requested the retention of the Northern No. 1 and Refuse <br />Facility access roads. The retention is compatible with the approved post-mining <br />9 <br />
