<br />Soils <br />Soils exposed in the removal o~ to rock from the South Waste Dump shall be sampled <br />and analyzed by LAC Minerals ,metals and nutrients. Based on the analyses LAC <br />Minerals shall determine, in c8 lion with the local conservation district or the <br />Department of Agriculture, the pro~tr soil amendments to establish a viable growth <br />medium to ensure revegetation success. <br />2. Any soil amendments shall be registered, as applicable, with the South Dakota Department <br />of Agriculture in accordance with SDCL 38-19A. <br />3. By May 1, 1994 LAC Minerals shall submit to the Department a plan for a soils and <br />vegetation investigation to be conducted for areas other than the pit, waste dump and leach <br />pads. The purpose of the investigation will be to determine impacts to area soils and <br />vegetation from the mining operation and acid mine drainage. These areas would include <br />the access road, the haulage road, ancillary facilities, and areas adjacent to the mine site. <br />By July 1, 1994 LAC Minerals shall complete the investigation and report the results of <br />the investigation to the Department. Based on the results of the investigation, if problems <br />are discovered with soils and vegetation in these areas, LAC Minerals shall develop and <br />submit a mitigation plan to the Department for approval. The mitigation plan shall <br />generally describe measures that can be taken to mitigate soils and vegetation problems, <br />and shall describe ongoing monitoring. An annual assessment of this issue will be made <br />by the Department of Agriculture and LAC Minerals at the annual Performance <br />Monitoring meeting described in the Performance Monitoring section of these conditions. <br />LAC Minerals shall maintain an effective dust control program for the amendment area. <br />Dust control measures shall include the use of water trucks, dust suppressants, dust filters <br />on equipment, and revegetating disturbed areas as soon as practicable. <br />2. LAC Minerals shall notify the Department within five working days of written complaints <br />of land owners adjacent to the operation concerning dust. LAC Minerals shall submit to <br />the Department a copy of any reports or mitigation plans submitted to Lawrence County <br />regarding the complaints. The Department, upon finding that a complaint is based in fact <br />on a potential permit violation, may require LAC Minerals to develop a mitigation plan <br />to correct the potential violation. The completion date for the mitigation plan will be set <br />at the time of the Department request. <br />Detailed plans and specifications for the capping system shall be submitted to the <br />
