Mn (diss.) <br />Pb (total rec.) <br />The Department reserves the right to modify the spring and seep monitoring schedule and <br />parameters if monitoring results indicate such a modification is warranted. <br />7. LAC Minerals shall monitor effluent from leach Pad Nos. 1, 2 and 3 for the postclosure <br />period to monitor for acid generation from the spent ore. If the material is found to be <br />generating acid, LAC Minerals shall notify the Department, and within a GO-day period <br />following discovery of acid generation, LAC Minerals shall develop and submit a <br />mitigation plan for Departmental approval under condition no. 5 above. <br />8. LAC Minerals shall begin remedial actions to mitigate the contamination in the shallow <br />groundwater system in Spruce Gulch, if: <br />a. The Department determines that contamination persists above the expected levels <br />as assessed during the annual performance monitoring meeting described in the <br />Performance Monitoring section of these conditions; <br />b. Interaction of contaminated groundwater with surface water causes a violation of <br />surface water quality standards; or <br />c. Contamination concentrations above South Dakota Ground Water Quality Standards <br />move off the mine property. <br />The remedial action shall be done in accordance with the contingency plan in condition no. <br />5 above. <br />If groundwater contamination continues or requires further mitigative actions beyond what <br />is specified in the amendment application or these conditions, additional groundwater <br />assessments may be required and LAC Minerals may be required to obtain a Groundwater <br />Discharge Permit. <br />9. Prior to the start of the postclosure period, LAC Minerals shall submit an updated <br />postclosure hydrologic monitoring plan to the Department for approval, including all <br />surface and groundwater quality monitoring stations, springs and seeps, lysimeters, and <br />thermistors, and including all monitoring parameters and sampling schedules. <br />The Department reserves the right to modify the hydrologic monitoring schedule and <br />parameters if monitoring results indicate such a modification is warranted. <br />10.
