<br />The bottom line is that the applicant needs to satisfy requirements of DMG and the U.S. Forest <br />Service. In case you aze not aware of it, we did notify Mr. Rubeck on 2/22/02 that he may need to <br />update his Plan of Operation with the USFS prior to any surface disturbance outside the existing <br />plan of operation azea. <br />You also requested that DMG provide you with copies of all future correspondence we send to, <br />" mining claimant conducting activities on the South Pazk Ranger District". For budgetary <br />purposes, statutory reasons, and since we do not have a cleaz understanding of the vazious District <br />boundaries, we can not comply with your request. Under our statute, all information submitted with <br />an NOI is confidential. The NOI approval does require that the applicant contact the Federal Land <br />Management Agency. We will, however, continue to send all non-confidential documents to your <br />Headquarters so they may distribute materials to the vazious Districts as they see fit.
