• Cultural Resources Conditions of Approval for Western Fuels-Utah <br />Mine Plan of Operation. <br />Western Fuels-Utah (Western Fuels) shall provide documentation to <br />OSM and BLM, White River Resource Area (WRRA), which clearly <br />indicates all planned operations to occur in the vicinity of known <br />archaeological sites 5RB 1082, 5RB 1143, 5RB 1145, 5RB 1146, and <br />5RB 3451, including an evaluation of potential subsidence effects. <br />The BLM through its Programmatic Agreement with the State Historic <br />Preservation Office (SHPO) and the Advisory Council on Historic <br />Preservation (ACHP), in concert with OSM shall conduct consultation <br />to determine what effect, if any, the plan of operations will have <br />on the sites, whether or not the sites are eligible for nomination <br />to, or listing on the National Register of Historic Places (NRHP) <br />and what treatment, if any, shall be required to mitigate any <br />potential adverse effects to the sites. <br />Western Fuels shall provide to OSM and BLM such information, site <br />evaluations, or proposed treatment plans as requested in order to <br />comply with the appropriate Historic Preservation legislation. If <br />changes should occur in Western Fuels' Mine Plan that could <br />potentially effect sites 5R8 1082, 5RB 1143, 5RB 1145, 5RB 1146, <br />and 5RB 3451, Western Fuels shall notify the OSM and BLM in writing <br />prior to conducting operations which could affect the sites. <br />• <br />C <br />
