Recommendation <br />• I recommend approval, with one condition, of the Deserado <br />Mine mining plan for Federal lease COC 51551. This mining <br />plan supplements the Deserado Mine mining plans for Federal <br />leases C-023703, D-047201, C-0126669, C-8424, C-8425, and C- <br />44693, approved on July 15, 1981, May 19, 1986, and May 10, <br />1988. My recommendation to approve the Deserado Mine mining <br />plan for Federal lease COC 51551 is based on: (1) Western <br />Fuels-Utah, Inc.'s (western Fuels') complete permit <br />application package (PAP), (2) compliance with the National <br />Environmental Policy Act of 1969, (3) documentation assuring <br />compliance with applicable requirements of other Federal <br />laws, regulations, and executive orders, (4) comments and <br />recommendations or concurrence of other Federal agencies, <br />and the public, (5) the findings and recommendations of the <br />Bureau of Land Management (BEM) with respect to the resource <br />' recovery and protection plan and other requirements of the <br />Federal lease and the Mineral Leasing Act, and (6) the <br />findings and recommendations of the Colorado Mined Land <br />Reclamation Division (NERD) with respect to the PAP and the <br />Colorado State program. <br />Approval of this mining plan will authorize mining of about <br />' 9.3 million additional tons of Federal coal and will add <br />• about 1,320 acres in Federal lease COC 51551 to the approved <br />mining plan approval area, as shown on the map included with <br />this decision document.
