Recommendation • I recommend approval, with one condition, of the Deserado Mine mining plan for Federal lease COC 51551. This mining plan supplements the Deserado Mine mining plans for Federal leases C-023703, D-047201, C-0126669, C-8424, C-8425, and C- 44693, approved on July 15, 1981, May 19, 1986, and May 10, 1988. My recommendation to approve the Deserado Mine mining plan for Federal lease COC 51551 is based on: (1) Western Fuels-Utah, Inc.'s (western Fuels') complete permit application package (PAP), (2) compliance with the National Environmental Policy Act of 1969, (3) documentation assuring compliance with applicable requirements of other Federal laws, regulations, and executive orders, (4) comments and recommendations or concurrence of other Federal agencies, and the public, (5) the findings and recommendations of the Bureau of Land Management (BEM) with respect to the resource ' recovery and protection plan and other requirements of the Federal lease and the Mineral Leasing Act, and (6) the findings and recommendations of the Colorado Mined Land Reclamation Division (NERD) with respect to the PAP and the Colorado State program. Approval of this mining plan will authorize mining of about ' 9.3 million additional tons of Federal coal and will add • about 1,320 acres in Federal lease COC 51551 to the approved mining plan approval area, as shown on the map included with this decision document.
