<br />United States Department of the Interior <br />OFFICE OF SURFACE MINING <br />Retlamatioa aad Enforcement <br />WASHINGTON, D.Q 20240 <br />JUL 151992 <br />r <br />~_J <br />• <br />Memorandum <br />iAl~~ ~ <br />PIIAEl1~ <br />~ ~ <br />~ ^ <br />To: Assistant Se retary, Land an inerala <br />Management <br />From: Director ~~ <br />Subject: Reco ation for Approval of Western Fuels- <br />Utah, c.'s Deserado Mine Mining Plan for <br />Federal Lease COC 51551, Rio Blanco County, <br />Colorado <br />I recommend approval, with one condition, of the Western <br />Fuels-Utah, Inc.'s (Western Fuels) Deserado Mine mining <br />plan for Federal lease COC 51551 pursuant to the Mineral <br />Leasing Act of 1920, as amended. This mining plan <br />supplements the Deserado Mine mining plans for Federal <br />leases C-023703, D-047201, C-0126669, C-8424, C-8425, C- <br />44693, and COC 51551, approved on July 15, 1981, May 19, <br />1986, and May 10, 1988. My recommendation to approve the <br />mining plan for Federal lease COC 51551 is based on: (1) <br />Western Fuels' complete permit application package (PAP), <br />(2) compliance with the National Environmental Policy Act <br />of 1969, (3) documentation assuring compliance with <br />applicable requirements of other Federal laws, <br />regulations, and executive orders, (4) comments and <br />recommendations or concurrence of other Federal agencies, <br />and the public, (5) the findings and recommendations of <br />the Bureau of Land Management with respect to the <br />resource recovery and protection plan and other <br />requirements of the Federal lease and the Mineral Leasing <br />Act, and (6) the findings and recommendations of the <br />Colorado Mined Land Reclamation Division with respect to <br />the PAP and the Colorado State program. <br />The Secretary may approve a mining plan for Federal <br />leases under 30 U.S.C. ~~ 207(c) and 1273(c). Pursuant <br />to 30 CFR Chapter VII, Subchapter D, I find that the <br />proposed mining plan will be in compliance with all <br />applicable laws and regulations. The decision document <br />for the proposed mining plan action is attached. <br />Attachment <br />
