Metal Mining SWMP Guidance Document
Page 14 ,
b. In the case of mine-waste remediation projects, the permittee has submitted photographic
documentation of the post remediation conditions at the mine site;
c. AIZ stormwater discharges to state waters associated with mining activities have ceased and the
permittee has demonstrated to the Division the termination criteria have been met or the CDMG
performance bond has been released;
d. The Division finds that the permittee has shown reasonable grounds consistent with the Federal and
State statutes and regulations for such termination; and
e. Fee requirements of Section 6.16.0 of State Discharge Permit System Regulations have been met.
Continued coverage may be required after reclamation or remediation has been completed if the Division has
shown or has reason to suspect that the stormwater discharge may contribute to a violation of a water quality
standard.
For permittees seeking termination through mine-waste remediation, the Division foresees three general cases
where the provisions allowed within the permit will be utilized.
Inactive mine sites where the permittee begins a remediation project in order to terminate coverage
under an existing permit. In this case, the permittee will amend their SWMP to address the
remediation concerns as outlined below, and proceed with remediation. Certification under this permit
would be terminated when the termination criteria and other conditions of the permit are met.
2. Inactive mine sites where no previous stotmwater permit coverage exists, and the owner or a third
party (with permission of the owner) plans to remediate the site. In this case, the SWMP would be
prepazed, including the items outlined below, and the owner or third party would submit the completed
permit application. Certification under this permit would be terminated when the termination criteria
and other conditions of the permit are met.
3. Inactive mine sites where, in conformance with the Voluntary Cleanup and Redevelopment Act, (CRS
25-16-303), mine-waste remediation projects aze undertaken. In this case, the SWMP would be
prepazed, relying in part on information contained in the Voluntary Cleanup Plan. Once the Voluntary
Cleanup Plan is approved by the Harardous Materials and Waste Management Division, the owner, or
third parry with permission of the owm, would submit the completed permit application. Certification
under this permit would be terminated when the termination criteria and other conditions of the permit
aze met.
Additional requirements apply In the tvtnt that the permittee wishes to remediate the inactive mine
site and terminate permit coverage. Ij the site is already covered by this permit, the permittee shall
notify the Division as to the change in status. Notification shall be prior to the implementation of
the remediation work, if possible. The SWMP must be amended to include the following items,
prior to implementation of the remediation work, if possible:
In the event that the permittee wishes to remediate an inactive mine site and terminate permit coverage, prior to
remediation activities, the SWMP must be amended to include the following items, and the permittee must
notify the Division of the change in status.
