Metal Mining SWMP Guidance Document
Page 13
4. Comprehensive Inspection
The SWMP shall identify qualifted personne6 that shall inspect designated areas. Inspections
required by this part shall be conducted annually. Where annual inspections are impracticable,
certification is required once every three years by a Registered Professional Engineer that the site is
in compliance with the SWMP.
See page 10 of this document for an explanation of this item.
5. Additional SWMP Items for Sites SeekinP Permit Termination
There are two methods available to permittees seeking to terminate permit coverage:
Termination through CDMG release - When a site has been reclaimed in accordance with the
Colorado Division of Minerals and Geology (CDMG) requirements and the site has been released
from State reclamation requirements, the operator of the facility may request termination.
2. Termination through mine-waste remediation -For facilities without CDMG permits, the permit
coverage may be terminated through mine-waste remediation. For mine-waste remediation projects,
additional SWMP items must be developed prior to implementation of the remediation work, as
described below. In addition, permittees seeking coverage under the Voluntary Cleanup Act must
notify the Division of their intent 30 days before any remediation activities commence.
Termination may then be requested once raw materials, intermediate products, byproducts, finished
products. and waste products have been removed or isolated from stormwater and the site has been
stabilized (with little evidence of soil erosion or other runoff problem) and revegetated. The following
criteria from the permit (section I.F.1) must be met for the entire mine site, including any on-site disposal
azeas:
I) all raw materials, intermediate products, byproducts, finished products and waste products
(including acid generating material exposed by the mining activity) have been removed or
permanently isolated from stormwater, and
2) all soil disturbing activities at the site have been completed; and
3) vegetation has been established with an average cover or density, over the previously disturbed
area, of a minimum of 40 percent vegetative cover ar 70 percent of the vegetative cover of a
similar undisturbed site, whichever is higher (vegetative cover or density determinations need not
be determined scientifically by extensive measurement and statistical analyses; simple
representative transects are adequate.); or equivalent permanent physical erosion reduction
methods have been employed.
The Division may, after consultation with the permittee and upon good cause being shown, revise
the vegetative cover requirement on a case-by-case basis.
Once termination criteria have been met under one of the above methods, termination of the permit may be
requested. The Division will consider termination of the permit when the following items from section I.F.2 of
the permit aze completed:
a. the permittee has submitted a completed Inactivation Form as provided by the Division which
summarizes the work accomplished;
