umma <br />The Review Process <br />The Munger Canyon [vline was permitted under the interim program on July 24, 1978 (Permit <br />No. 78-57). Sheridan Enterprises, Inc. submitted an application for a new permit on December <br />12, 1980 pursuant to Section 34-33-]09 of the Act. <br />During permit application review, ajoint venture company was formed to develop the mine. <br />This company was known as Salt Creek Mining Company and was a subsidiary of Sheridan <br />Enterprises and Colorado-Ute Electric Association. Permanent program approval was granted <br />when the operation was permitted on January 12, 1983. The Munger Canyon Mine has been <br />under temporary cessation since January l7, 1984. On June 27, 1984, Salt Creek Mining <br />Company applied for a revision to the permit to construct a central facilities azea, coal processing <br />waste embankment and interconnecting haul road and conveyor system. The revision to <br />construct a central facility azea was approved on September 24, 1985. No construction has begun <br />on the central facilities azea. On November 13, 1992, Salt Creek Mining Company submitted an <br />application for a transfer and succession of operators. The permit was transferred to Grand <br />Valley Coal Company on Mazch 2, 1993. <br />On Mazch 31, 1997, the Division notified Grand Valley Coal Company that the five-yeaz permit <br />term for the Munger Canyon Mine would expire on January 12, 1998. Grand Valley Coal <br />Company submitted a permit renewal application on August 1, 1997. The application was <br />deemed complete for purposes of filing on August 11, 1997, and the proper notification was sent <br />to parties identified in Rule 2.07.3(3)(b). A public notice of the application was published in the <br />Glenwood Post once a week for four consecutive weeks beginning February 11, 1998. No <br />comments were received by the Division. <br />On August ] 4, 1997, the Division requested comments from various Federal and State agencies <br />regazding the permit renewal application. The Division received one comment on the renewal <br />application by the U.S. Army Corps of Engineers (the Army Corps) regazding certain <br />information on location and extent of surface disturbance. The questions were addressed by <br />phone on August 26, 1997, and a general location map and surface disturbance map were faxed <br />to the local Army Corps office in Grand Junction on that date. The agency's questions were <br />resolved by the information provided apd they made no further comment. <br />The Division queried the Applicant Violator System (AVS) on February 3, 1998 to obtain a <br />recommendation for approval of the permit renewal based on the applicant and its owners' and <br />controllers' compliance record. The system recommended that the application be denied since <br />the officers of Grand Valley Coal Company were linked to a state cessation order issued to a coal <br />mine in the State of Utah. A follow up recommendation by the OS1v1 on February 6, 1993 <br />verified that the Utah cessation order is outstanding. On Ivlarch 9, 1998, the AVS cleared the <br />Utah violation, but issued a recommendation of'`deny" for failure to submit the quarterly OS~I-1 <br />s <br />
