Proposed Decision <br />The Colorado Division of Minerals and Geology proposes to approve with stipulations a permit <br />renewal application for a valid existing permit to conduct surface coal mining operations at the <br />Munger Canyon Mine. <br />The application was submitted by Grand Valley Coal Company for the Munger Canyon Mine. <br />This decision is based on a finding that the operations will comply with all requirements of the <br />Colorado State Program as found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. <br />34-33-101 et seq., and the Regulations promulgated pursuant to the Act. If no request for a <br />formal heazing is made within thirty (30) days of the first publication of the issuance of this <br />proposed decision, then this decision becomes final. The permit application, all supporting <br />documentation and any stipulations or conditions will become a binding part of the permit. <br />Stipulations 1 through 17 had previously been attached to the permit. Stipulations 18 through 21 <br />were issued during past renewals and revisions to the permit. The operator has complied with <br />the requirements of Stipulations 2, 4, 6, 8, 9, 10, 11, 13, 18, 19 and 21. Stipulations 22, 23, 24, <br />and 25 were issued during the midterm review and subsequent revisions to the permit. <br />Stipulations 22, 24 and 25 have been complied with. No new stipulations were added to the <br />permit for this permit renewal. <br />Stipulation No. 1 <br />SIX MONTHS PRIOR TO THE DRIVING OF ROCK SLOPES WITHIN THE HUNGER <br />CANYON MINE FROM THE CAMEO COAL SEAM TO THE UPPER CARBONERA COAL <br />SEAM, THE APPLICANT MUST SUBMIT GEOCHEMICAL AND PHYSICAL ANALYSES <br />OF THE UPPER CARBONERA ROOF AND FLOOR STRATA AND ALL INTERBURDEN <br />STRATA BETWEEN THE CAMEO AND UPPER CARBONERA COAL SEAMS WHICH <br />WILL BE ENCOUNTERED IN THE ROCK SLOPES. <br />Stipulation No. 3 <br />THE APPLICANT MUST SUBMIT TO THE REGULATORY AUTHORITY AN ANNUAL <br />REPORT CHARACTERIZING THE INFLOWS, DISCHARGES AND THE CONSUMPTION <br />OF WATER WITHIN THE MINE. THIS REPORT IS TO INCLUDE A CURRENT MINE <br />WORKINGS MAP SHOWING THE LOCATION AND QUANTITY OF INFLOWS: A <br />TABLE KEYED TO THE MINE MAP WHICH SHALL CONTAIN THE SOURCE (i.e., <br />FAULTS, FRACTURES. ETC.), QUANTITY, DURATION, AND QUALITY (i.e., pH, <br />ELECTRO-CONDUCTIVITY AND TEIvIPERATURE) OF ALL NON-SEEP INFLOWS; A <br />TABLE CONTAINING RECORDS OF WATER DISCHARGED FROM THE MINE. <br />CONSUMED IN THE MINE AND IMPORTED FOR USE WITHIN THE M[NE; A <br />
