' AHer the two Appendices are two Inserts. Insert #1 contains a revised Mine Plan that
delineates mining areas to date and projected areas ofmined during the next 2+years with a
final mining date of December 31, 2009. Insert #2 delineates the final reclamation of the
property with only the reclamation date being modified to December 31, 2010.
In summary, AI has demonstrated that:
' 1. The proposed Conditional Use Amendment is consistent with the intent of the Adams
County Comprehensive Plan, since the additional time is needed for the mining and
reclamation of the property in accordance with previously approvals.
' 2. The proposed Conditional Use Amendment is consistent with purposes of the County's
standards and regulations, and can comply with the requirements of the County's
' standards and regulations including the requirements for adequate drainage facilities and
measures to mitigate off-site impacts during mining activities.
' 3. The proposed Conditional Use Amendment is compatible with the surrounding area,
harmonious with the character of the neighborhood, not detrimental to the immediate
area, not detrimental to the future development of the area, and not detrimental to the
' health, safety, or welfaze of the inhabitants of the area and the County.
' Based on the above, and the information provided in the two Appendices and Indexes, AI
would request a favorable recommendation from the Planning Staff and the Planning
Commission, and a favorable decision from the Boazd of County Commissioners on this
' Conditional Use Amendment request to extend both the Mining and Reclamation Plans
completion time limits.
C
1

1
