The mining lake setback from the riverbank is shown as 700 feet. The existing riverbank Fes <br />1 not been stabilized, Therefore, in accordance with the mining regulations; the mining setback <br /> sha31 be a minimum of 400 feet from the top of the riverbank, unless adequate documentation <br /> is provided showing haw, when, and whom will be responsible for the riverbank and pits3de <br />1 bank stabilization. The mixing regulations show for 100 feet setback only if the riverbank <br /> and the pitside bank are stabilized. <br /> 17. All fuel tanks shall be elevated a minimum o£ one foot above the 100-year flood elevation <br />1 and installed away from the floodway. <br /> 18. The temporary overburden and topsoil stoclpiles shall be placed s maximum of 20 feet in <br />1 height and 700 feat in width with 100 foot gaps between maximum 300 foot long piles. The <br /> piles shall be placed parallel to-the overlaank flow dueotion. In addifion, the piles or any <br /> other development within the floodway will be prohibited unless hydraulic modeling of the <br />1 100-year flood shows no increase in the 100-year flood elevation. <br /> 19. Should the Urban Drainage and Flood Control District recommend lakeside spillway(s) <br /> consfruc6on, the operator shall present the final design of the spillway structure(s) for <br />1 approval by the District and Adams County and shall construct the spillway(s). <br /> 20. All conditions precedent must be satisfied prior to commencing operations on the subject site. <br /> Proof that the concerns have been addressed wi13 require a Notice to Proceed from the <br /> Department of Planning and Development <br />21. The mining operations shall be wmpleted no Later than September 7 8, 2007. <br />22. The site shall be reclaimed in accordance with the reclamation plan no later than January I, <br />2009. <br />
