Except any portion of said tract within that parcel conveyed to the Denver <br /> Larimie and Northwestern Railway Company by Deed recorded September 8, 1908 in <br /> Book 39 at Page 125. <br />1 APPROXIMATE LOCATION <br />d <br />14150 Ri <br />d <br />l <br />R <br /> e <br />. <br />: <br />ver <br />a <br />oa <br /> WI~REAS, substantial testimony was presented by members of the public and the applicant; <br />1 and, <br /> WHEREAS, the Adams County Planning Commission held a public hearing on the 24th day of <br />1 August, 2400, and forwarded a recommendation of APPROVAL to the Board of County <br /> Commissioners. <br /> NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, County of <br />1 Adams, State of Colorado, that based upon the evidence presented at the hearing and the <br /> recommendations of the Department of Planning and Development and the Planning <br />1 Commission, the application in this case he hereby APPROVED based upon the following <br />findings of fact and is subject to the fulfillment of the following conditions precedent and <br /> stipulations by the applicant: <br />Findings Of Factc <br />I. The Adams County Zoning Re lotions allow mineral extraction operations in the A-1 Zone <br />District receiving Conditional Usa Permit approval. Negative externalities ftom these types <br />of land uses are usually related to dust, noise, truck traffic, and damage to existing water <br />wells. Provided the applicant transports all material to the east, across the South Platte River, <br />and out to Brighton Road, this request has demonstrated the ability to comply with the <br />requirements of the Adams County Zonin¢ Reeulafions, and the area in which it is located. <br />2. The Future Land Use Map of the Adams County Comprehpnsive Plan designates this <br />property Agriculture. The use of this property for grave] mining operations will not affect <br />this designation. Therefore, the use of this property for the proposed uses would be <br />consistent with the intent of the Adorns County Com~ehensive Plan for this area of the <br />County. <br />3. Under Section 6,200 of the Adams County Zoning Reeulations, the Board of County <br />Commissioners may require conditons of approval to make a ]and use compatible wifh the <br />area. This case is also subject to the operation and rehabilitation standards outlined in <br />Section 1 i 34D of the Adams County Zoning_Reeulations. Provided all of the conditions and <br />stipulations era adhered to with this project, the operations will not be detrimental to the <br />health, safety, or general welfare of the inhabitants of the area and the County. <br />Conditions Precedent: <br />
