<br />II. Suaaort Facilities -Rule 4.04 <br />A. No specific approvals have been granted. <br />III. Hvdrologic Balance -Rule 4.05 <br />A. Water quality standazds and effluent limitations <br />The Division proposes to grant two small azea exemptions from use of <br />sediment ponds due to the limited size of the azeas and due to the fact that <br />ponds and treatment facilities aze not necessary for the drainage to meet the <br />effluent limitations of Rule 4.05.2 and applicable State and Federal water <br />quality standazds for receiving streams. No mixing of surface drainage with a <br />discharge from underground workings will occw. The small areas to be <br />exempted aze located as depicted on Map 12 and aze labeled as the Topsoil <br />Stockpile/Trailer SAE and the CWD1 Disturbance SAE. (4.05.2(3)(b)(I)) <br />B. Diversions and Conveyance of Overland Flow <br />The Division proposes to approve the use of shotcrete and riprap lining for a <br />permanent diversion. The lining will prevent seepage and provide stability in <br />order to protect fills and property and to avoid danger to public health and <br />safety. The section of diversion affected is the lower section of refuse ditch no. <br />1 as shown on Map 12. (4.05.3(3)) <br />C. Stream Channel Diversions <br />The Division approves the diversion of an intermittent stream. This decision is <br />based on a finding that the proposed diversion meets the requirements of <br />4.05.18 and 4.05.4, applicable local, State, and Federal statutes and regulations <br />and that the diversion is designed to safeguazd public safety and to minimize <br />adverse impacts to the hydrologic balance. (4.05.4(1) and (4)) <br />2. The Division approves a permanent diversion. This diversion is consistent with <br />applicable state law, will not diminish downstream water rights and meets the <br />requirements of Rule 4.05.4. (4.05.4(4)) <br />The permanent diversion shall make use of artificial structural controls in order <br />to allow it to remain in dynamic equilibrium with the drainage basin system. <br />The Division approves the use of such structures.
