<br />r~ <br />determined that the land use as defined by Rule 1.04(71)(c) as "rangeland" meets the <br />requirements of Rule 4.16 for the permit azea at the mine site (2.07.6(2)(1)). The <br />loadouts have been returned to the pre-mining, industrial use. <br />13. Specific approvals have been granted or aze proposed. These approvals aze addressed in <br />the following section, Section B (2.07.6(2)(m)). <br />14. The Division finds that the activities proposed by the applicant would not affect the <br />continued existence of endangered or threatened species or result in the destruction or <br />adverse modification of their critical habitats (2.07.6(2)(n)). <br />15. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As <br />of this time, Energy Fuels Mining Company, the operator is current in the payment of <br />reclamation fees required by 30 CFR Chapter VII, subchapter R (2.07.6(2)(0)). <br />SECTION B <br />The following findings and specific approvals aze required by Rule 4: <br />Roads -Rule 4.03 <br />A. Haul Roads <br />The Division approves the retention of the haul road depicted on Map No. 12 <br />since it is compatible with the approved post-mining land use of rangeland and <br />a request for its retention was submitted by the landowner. (4.03.1(1)(f)(I)) <br />2. The Division approves the alteration or relocation of a natural channel <br />drainageway located in Stazkville Gulch. The applicant has successfully <br />demonstrated that the natural channel drainage will not be blocked, no <br />significant damage will occur to the hydrological balance, and no adverse <br />impacts will occur to adjoining landowners. (4.03.1(4)(a)(I)) <br />B. Access Roads <br />The landowner has requested the retention of the access road depicted on Map <br />No. 12. It's retention is compatible with the approved post mining land use of <br />rangeland. Therefore the Division approves retention of the access road. <br />(4.03.2(1)(f)) <br />C. Light-Use Roads <br />No specific approvals have been granted. <br />to <br />
