<br />-6- <br />30. Within 60 days of approval of the mining permit, the applicant shall pro- <br />vide ditch dimensions for the entire "north topsoil ditch" in the D-Portal <br />area. These plans must be submitted and approved prior to the onset of con- <br />struction at the D-Portal area. <br />31. Within 60 days of approval of the mining permit, the applicant must sub- <br />mit the calculations and assumptions used to size the railroad loop sedimenta- <br />tion ponds, and must resize the outlet culvert at sedimentation pond ~/4 in the <br />Railroad Loop to prevent excessive ponding at the entrance or 3ustify the <br />present sizing with appropriate calculations. The lower segment of the sub- <br />area R4 refuse ditch must also be resized to accomodate the 10-year 24-hour <br />flow. This must be completed and plans approved by the regulatory authority <br />prior to the onset of work at the Railroad Loop. <br />32. The applicant shall submit to the regulatory authority within 90 days a <br />modified restoration plan for Scullion Gulch to omit the thirteen proposed <br />in-channel rock check dams. In lieu of these, the applicant shall install <br />three dams or sediment traps, built to SCS or U.S. Forest Service specifica- <br />tions, at the downstream construction limits in Scullion Gulch. These traps <br />should provide sufficient storage to store one year of sediment accumulation <br />from D-Portal area. The traps must be installed prior to the onset of recla- <br />mation, cleaned periodically throughout the reclamation period and removed <br />when the appropriate regulatory authority has deemed the reclamation profess <br />effective. Codified restoration plans reflecting the above stipulations`must <br />be submitted to the regulatory authority within 90 days of permit approval. <br />33. The applicant must provide the regulatory authority with plans to resize <br />the D-Portal area and DP-1 principal spillway to allow a maximum head of only <br />one foot above the riser crest or provide additional freeboard between the <br />riser crest and emergency spillway crest. The revised plan should be submit- <br />ted within 90 days of permit approval. <br />34. Within 30 days of permit approval, the applicant shall commit to the <br />regulatory authority to comply with the following requirements: <br />(a) to implement sediment control measures prior to the onset of construction <br />of the coal transport and storage area; <br />(b) to provide emergency and principal spillway outlets with appropriate <br />erosion control prior to the construction of sediment ponds; <br />(c) to provide baffles on each of the Refuse Disposal Area sediment ponds as <br />necessary; <br />(d) to provide quarterly reports to regulatory authorities as~required by Rule <br />4.05.9(8) of the Colorado Regulatory Program; <br />(e) to notify the regulatory authorities within five days after analytical <br />results of surface water samples indicate that noncompliance with permit <br />conditions or applicable standards has occurred, as required by Rule <br />4.05.13(2}(a)(ii) of the Colorado Regulatory Program; <br />
